The Ht'tion comes on a petition fur a writ of prohibition pro-hibition to restrain Judge Howii.hu from assuming jurisdiction in the trial of the case ajjainut H. J. Carrigan, charged with gambling for the alleged ( maintenance of a pool for betting on horse race;, in the rear of 225 South Main street. Carrigan was arretted, by Patrolman R. A. Kadke June 27, last, and a complaint com-plaint was isHtied charging him with conducting gambling, t arrigan Hied a demurrer tot he complaint oa tiiiu groumltt that the complaint was not in accordance with the requirements of the state law and that the ctty court had no jurisdiction in t he matter. Th demurrer was overruled and the trial set for Friday morning at 10 o'clock. Setting out that he might he convicted con-victed at the trial if it were held and on the ground that the city judge was without jtirisdiriion in the" case, Carrigan Carri-gan applied to the third district court for a writ of prohibition restraining fudge Bowman trom continuing with the trial. The writ is in the form of an order to show cause, returnable at It) o'clock Wednesday morning, July 2h Carrigan alleges that the cjty had not the right to paste the ordinance under which he was arrested and the complaint com-plaint issued. The case is one of conniderahlo interest, in-terest, as it involves the question of the authority of the city in the matter itt race track gambling which has been questioned before. This is the first time that legal steps have been taken to teat the ordinances. |
