Diehl, the Denver diamond ealesman, who claimed that he was robbed of diamonds vetoed at 87000, and who appeared as a witness in the trial of Gladvs Whitney, who waa acquitted ac-quitted of the theft of the diamonds, waa in two kinds of -legal trouble yeaterday. When Diehl waa subpoenaed by Deputy Dep-uty Sheriff W. B. Booth to appear as a witness in the cane of the state against Walter W. Perrv, charged with grand larceny, Diehl said ha would not appear, and that if he appeared it would be because the officers had kept him in ia.il. aad then he would not testify. tes-tify. Diehl was baled before Judge. Lewis and apologized to the court itl a humble manner, and was thea re a leased on his own recognizance. He pleaded that his wife waa sick in Denver Den-ver and he desired to" go to her as soon aa possible. .Inrlge Lewis informed him (hat he must be in court at 10 J o'clock Monday morning or pay the penalty.
