Show Falkenrath Promotion Suit Advised for S. L. City Attorney Urges Action to Define Lines of Authority Over Police Department In five-page opinion, City Attorney At-torney Fisher Harris on Tuesday advised Salt Lek City commissioners commis-sioners that they direct him to bring a friendly suit in district court under un-der th declaratory Judgment act and carry the case to th Utah supreme su-preme court to test recent action of th civil service commission affecting af-fecting the promotion of Police Officer Of-ficer Sherman Falkenrath. It also recommends th officer retain the rank of captain. A civil service ruling on April 28 refused to approve Officer Falkenrath' Falk-enrath' promotion to a captaincy, after he had served in that capacity for IT months. The officer reverted to th tank ef sergeant. ( Assuming the commission had authority to act en th promotion in th manner It did, the opinion states, the officer should not nave been required to take a rank lower than lieutenant th rank bald by him when the chief of police recommended recom-mended hint for promotion to a captaincy. "The civil service commission Is composed of able and honorable men . . . actuated by the highest motives . . . their Judgment is at variance with mine and that Judgment Judg-ment I respect at least aa greatly as my own.
