Lev Jr. 5 Officials of Davis County Sued on False Arrest Charge $10,245 Demanded in 50-Day Imprisonment for 'Nonexisting' Offense - Five Davis county officials were named in a $10,243 suit alleging false arrest filed Saturday in the Salt Lake county clerk's office. ' Named in the suit are Sheriff Joseph Jo-seph Holbrook, Deputy Sheriffs Calvin Cal-vin G. Roberts and Waynard Bennett, Ben-nett, County Attorney Orlando J. Bowman and Justice of the Peace A D. Ford. Bondsmen for th official, offi-cial, th National Surety corporation, corpora-tion, the Employer' Liability As-suranca As-suranca corporation, Ltd., and th United Bute Fidelity and Guaranty Guaran-ty company, also were named. Th complaint ia signed by Jua-tino Jua-tino Arroyo, Who alleged he was arrested falsely July IS by th three peace officer for possession of marijuana. According to th complaint, th statute on which Arroyo was arrested, ar-rested, section 7-U2, revised statutes stat-utes of Utah, 193$, was repealed by chapter 80 of th 1S3S session laws, and therefor ths offense with which be was charged did not exist. Th complaint further eet forth that th peace officer entered hi horn without a warrant, took him to th county Jail, where they served th complaint, then haled him before Justice of the Peace Ford, who bound him over for trial' to district court, snd that Arroyo was held In the Davis county jail . 90 dsys. All these proceedings were mystifying mys-tifying to Arroyo, the complaint sets forth, because h could not road, speak or understand English, and the officers assertedly did not furnish fur-nish him with an interpreter. |
