Show DECLARE 600 WOMEN f HAVE VIOLATED THE LAW ' Sensational Statement in Hearing of Dr. Payne, Who Will Know His Fate on Saturday. Thi arguments In the preliminary hearuig of Dr. K. S. Tayne, charged with murder in the second degree, were concluded before City Judge C. B. Dlehl yesterday afternoon, and the case was takes under advisement by him until Saturday afternoon at 2 o'clock, when he will render his decision on the motion mo-tion of Attorney Will F. Vv'anless to dismiss the complaint. In support of his motion to dismiss the tomplaint. Attorney V.'anless i viewed the testimony, word by word, i tracing the actions of Miss Hill from the moment she left her home until she died. j He denounced Dr. Mayo and de- dared that ho conducted an unfair au-lopsjf, au-lopsjf, nnd scored hi;n for directing the j city khemist to iind, if possible, traces of ctloiofoim in the stomaoh of the ! dead! woman. He criticised Dr. Mayo I also .for his statement that during the ; past two years 600 women had been1 guilty of performing criminal opera- j tlona upon themselves. Mr Warless laid great weight on the time the operation was alleged to have been performed. According to the statements of the physicians It must d have been performed two hours beforo ; death, at which time she was on the street and in fcuod health. ' The evidence was certainly, good proof thai Miss Hill had performed the operation upon herself, after which she had gone to Dr. Payne for relief from the pain induced by her act, the attorney attor-ney declared. In answer to these con'entlons. County Coun-ty Attorney WesHi velt denied that the physicians had testified that the operation opera-tion whs performed two hours before Miss Hill s death, but that It had be n performed not more than two hours, '" and possibly less than that time before death. Thi3 difference in interpretation was largely the reason the cpse w;ls taken '" under advisement for so long a time. In closing the argument for the State County Attorney Westervelt said that the Inevitable' conclusion was that the operation was performed by Dr. Payne i "" ! as no one else was present at the tlmev I Miss Hill was in his offlce. He appealed V, to the court to hold the defendant over -a to the District court for trial. |
