Show ATTORNEY IS AGAINST IT Declares Proposed Peddler's Ped-dler's License Is Unconstitutional. Un-constitutional. The members of the Retail Grocers and Butchers' association declare that many of the peddlers who Bell meats, vegetables and produce from wagons,-from wagons,-from house to house, are guilty of using us-ing short weight scales and measures. The association has asked the City Council to raise the peddlers' license to such an amount that It would be prohibitive. pro-hibitive. About 93 per cent of the members of . the association signed the petition that ' was sent to the Council. This was re-I re-I f erred to the License committee. When I It came up for discussion it was sent to the City Attorney, who was asked to draft an ordinance in accordance with the demands of the association. The present license fee is S6 per quarter quar-ter or $25 per year. The association asked that it be increased to $00 per quarter or $200 per year. Assistant City Attorney Bramel said yesterday that the association's demands de-mands are in violation of the statutes. Such a step would be an act of prohibition prohibi-tion w hich would not pass the inspection inspec-tion of the Supreme court and would be declared unconstitutional. Mr. Bramel is preparing a communication to the committee embodying these facts. Mr. Bramel said yesterday that if the allegations of the association are true, redress can be secured in the courts rather than in the Council. If such a condition exists it would be an easy matter to prove it and follow It up with prosecutions. |
