Irvine, May 12, Immediately following follow-ing the trial of Angeline Wacaster for Ilrst degree murder In connection with the death of Charles A. Faua. Hhe has demanded de-manded a separate trial In the district dis-trict court. Gardner, after killing Deputy Sheriff Cordon Stuart when the latter served claim and delivery papers on the Gardner Gard-ner ranch near Welby, pursued Irvine down a ravine and shot him! Mrs. Gardner is accused of having brought to him the horse with which he pursued pur-sued Irvine and urged him to "go get Jrvlne: go get the guilty man." f Gardner and Mrs. Gerrans were arraigned ar-raigned for pleas this morning before Judge M. L.. Ritchie. The complaint was aganst George and Martha Gardiner Gard-iner and Mrs. Gerrans responded to the name of Mrs. Gardner. Judge Htchle advised the defendants that they might have at least twenty-four hours' time to consider their plea. flurdner. receiving a nod from K. F. Allen, his attorney, said In a firm, low voice: "I plead not guilty." lie exhibited ex-hibited no signs of emotion. Mrs. Gerrans consulted for a moment mo-ment with J. K. Darmer, her attorney, and also entered a plea of not guilty. District Attorney K. A. Rogers aked that the court set the date of trial as May 22, Immediately following the trial or Angeline Wacaster. After Judge Ritchie had fixed the date of trial, Mr. j'unner requesiea ana was granted a separate trial for Mrs. Gerrans. L'pon the request of District Attorney Attor-ney Rogers the trial of Mrs. Gerrans will come before that of Gardner on the Irvine murder charge. Indications are that If Gardner Is convicted of the murder of Gordon Stuart the charge of murdering Irvine will not be preesed. Sarah Gerrans, l$-year-old daughter of Mrs. Gerrans. was in the courtroom when her mother was arraigned. Following Fol-lowing the setting of the date for trial she accompanied her mother and Darmer to the elevator. For the first time since their arrest April IS Gardner and Mrs. Gardner were able to converse for a moment with each other. Neither discussed the double murder at the ranch near Welhy, the conversation being confined to directing Surah Gerrans to bring thein articles of clothing of which they are in need. . |
