Show BRIGHAM CITY SAND PIT CASE DISMISSED BRIGHAM CITT. Nov. IS. H. C Carver, Car-ver, former city engineer of BrUrham City, has been exonerated In connection with an alleged irregular transaction in disposing of a sand pit east of Brishara to the city two years ago lot $2475. The city officials alleged that the price was exorbitant and that Mr. Carver received a commission which he was not entitled to while acting as a city official. Former Mayor John K. Krdmann d former Councilman R. A. Madaen were appointed a committee of two to purchase pur-chase a sand pit for the city. Mr. Carver, Car-ver, It is saM, held an option on the A J. Munns pit east of Brigham. which he sold for J247T. The committee held that the city was in need of .1 sand pit and that the price was reasonable. The new administration, however, disagreed dis-agreed with the old administration and ordered the money paid back to the city. This Mr. Carver refused to do. and contended con-tended that the sale was a legitimate one and that he was entitled to the price paid. Bolt was then brought. The trial of the case was held here before Judge Pratt, of Ogden. As MOO as the arguments of counsel were completed com-pleted the actfon was dismissed on the ground of no cause of action. |
