Bound Over to Court cn Own Request by Douglas Doug-las Magistrate. i DOUGLAS, Ariz., Aug. 15 L'pon ; their uv.u request, forty-nine residents of Lichee, Ariz., were this morning in the local justice court bound over to the superior court for trial on charges I of kidnaping growing out of their alleged al-leged participation in the deportations that followed the I. W. W. trouble in the Warren mining district in July, 101". Xo objections were offered by the county attorney and all were immediately im-mediately released under $2000 bond each to await the action of the higher court. The entire incident occupied less than fifteen minutes. Another surprise was when counsel for 200 additional Bisbee and Douglas citizens, arrested several weeks ago on a blanket warrant charging kidnaping, Hunouneed Tiiat the defendants were ready j,r their hearings and demanded that, under the law, The eases be called at once. County Attorney Robert . French objected on the ground that he was having trouble getting witnesses from points outside the state and that he needed more time to prepare the state's case. After a brier but vigorous vigor-ous argument the question of time was compromised, Justice W. C. Jack setting set-ting August 25 as the date for starting start-ing th" joint hearing. The court stated that, if the state could not produce its evidence on that date the entire complaint com-plaint would be dismissed. Justice Jack's little courtroom was crowded with defendants, their friends :md witnesses when court was opened. It had been expected that attorneys for the defense would artjite to have many of the cases dismissed far lack of evidence, evi-dence, but hardly had the court quieted down when Attorney W. H. Burgess, chief counsel for the defense, arose and requested on behalf of his clients thai all the defendants be bound over for trial. The prosecution acquisced and the court complied. Because of the number of defendants, defend-ants, including 170 citv officials, bank- oi s. ntiornovs. merchaius and miners of the Warren district, only afternoon hearings will oe held when the blanket warrant is taken up.
