Though the fusion candidate, James 71. Mayes, received a majority of the votes of district l.iti, entitling the Democratic-Progressive Democratic-Progressive combination to name the registration reg-istration agent, it occurred that a Republican, Re-publican, Mrs. Walter Cooper, was named. Discovery of the fact that Mrs. Cooper is a Republican resulted in a letter of protest addressed to the county commissioners commis-sioners over the signatures of both the Democratic and the Progressive county chairman. The county commissioners admitted ad-mitted that the protest was well founded, but expressed doubt of their authority to make a change after registration for the coming election had actually begun. They accordingly appealed to tlie county attorney at-torney for an opinion. Following is the opinion written In answer to their question: Referring to your letter of October 4, 191fi, relative to the appointment of a registration agent in district 156, beg to advise: As I understand the situation the commission is desirous of appointing an agent in this district of the same political party with Mr. Mays, in compliance com-pliance with section 71)5 of the compiled com-piled laws of 1P0T. Mr. Mays having received the highest vote cast tn this district for representative in congress at tlie st election, the question in the mind of tlie board apparently being its power so to do at this time. Section 819 provides that registration registra-tion agents are subject to removal at any time by the board of county commissioners. com-missioners. Tliere seems to be no legal objection to your board making an appointment ap-pointment at this time of a registration registra-tion agent in accordance with the provisions pro-visions of section 795. |
