Show i RIGHT OF WAY IN DISPUTE. 1 W. G. Wilson Claims Title to Land Over j Which Franchise Has Been Granted. , Special to The Tribune. ; OGDEN, Aug. 12. Unless immediate v arrangements are made for a right of way for the Ogden canyon pipe line across property that is said to be privately owned by William G. "Wilson, injunction proceedings are threatened against Ogden City and the city commissioners, according accord-ing to a communication received by the board this morning-. The ultimatum is issued by H. H. Henderson, attorney for the Ogden canyon hotel man, and the matter was promptly referred to the city attorney. . i The threatened legal proceedings against the city result from a misunder- I standing, according- to Attorney Henderson, Hender-son, respecting title to certain property 1 on which Mr. "Wilson has given the county an easement for highway purposes. The , route of the canyon pipe line is along the county road, but the attorney asserts that the county has no legal right to give a right of way over property to which it has no title. The communication gives the commissioners commis-sioners until August 13. Friday, to enter into negotiations with Mr. Wilson for the use of his land. The franchise granted by the county commissioners for the new pipe line from the municipal wells to the city reservoirs 1 carried no stipulation respecting the prop erty alleged to be owned by Mr. Wilson. Wil-son. It is also a free grant, the only consideration con-sideration being that the city restore the roadway to its normal condition. |
