Show IPEBSOHJIL SERVICE j SYSTEM ADVOCATED: Idaho Jurist Has Plan Aimed to Simplify Interstate Inter-state Practice, A suggestion which has met with approval ap-proval was made yesterday by Judge George D. Avers, dean of the law department de-partment of the University of Idaho. ! Judge A vers 'n suggestion in brief is ; that the itjcs tako advantage to a greater extent of thut clause in the con- stittition which gives them power to ; make agreements among themselves bv the consent of congress and to establish a system of personal service in inter-! inter-! statu law by which a citizen of one j state could bp personally represented in another state without invoking the aid I of the federal courts. Judge Avers pointed out that in the case of divorce suits, which he claims admit of much injustice at present, the existence of a system of personal interstate inter-state representation would -give the defendant de-fendant a chance to state his case through an authorized agent without regard for geographical boundary lines. In speaking of the plan Judge Ayers said: A system of personal service from state to-state would be a bond of sympathy that would tend to make tho bonds of fellowship and fidol-itv fidol-itv to the union stronger and of . greater significance. States far removed from one another an-other would be connected' directly and empowered to transact legal I business without having to make 1 tho suggestion through the federal ' authorities. 1 In presenting his suggestion to the 1 uniform law conference Judge Ayers moved that a special couimittee be ap-i ap-i pointed to consider the question of pre-paring pre-paring an enabling bill or bills to ,be : presented to the congress of the United States, which will permit a more general use of agreements between the several states. |
