Grant, pending a final hearing on tho writ, was made before Judge M. L. "Ritchie in the district court yesterday. yes-terday. llarrj- .T. Robinson, counsel for tho justice of tho peace, argued at length that the district court had no jurisdiction jurisdic-tion over the acts of Iho justice court in such a matter, lie declared that, a writ of prohibition was an extraordinary extraordi-nary procedure and one to be resorted to only when no other method of re- lief is at hand. In this case, he declared, de-clared, an appeal from whatever judgment judg-ment Hie justice of the pouce might have rcudercd against the chief of police po-lice would have presented the same avenue of relief. Also he challenged the right of the district court to act in the matter until the lower court had itself entertained a defeuse on the part of the persons accused of the contempt. con-tempt. The arguments wore continued until next Saturday morning. |
