ALLEGED BREACH OP ! CONTRACT IN LAWSUIT i I Paniel W. Lipinan's suit against I Edward V. Knotts et al. was laken i up beforo a jury in Judge Lywis's court Tuesday. The suit is the out-i out-i growth of an agreement alleged to have been entered into by tho plaintiff and his bother to purchaso a one-half interest in the grocery business of the defendants on First and O streots and the refusal later of tho defendant b to live up to the icrnis of tho agreement. The plaintiff demands damages in the sum of l.-ill.-lO, arising from ex penscs incurred iii taking stock, ex porting books, etc. The defendants deny the material allegations of the complaint.
