Judge Dunne this morning administered a remarkable re-markable rebuke to Presiding Judgo Graham when he learned that tho latter is prepared to consider the motion of tho attorneys for Mayor Sch'mitz to have, his case transferred to another court. Judge Dunne not only directly accused Graham of interfering with the business oi his department, but declared de-clared with an air of finahtj' that if the SchmitZ ease is taken away from him the Ruef case must go with it. On that account he contlnuel the proceedings pro-ceedings looking to the. setting aside of the indictments against Ruef until Wednesday morning at 10 o'clock, at which timo Judge Graham will have made it evident whether he intends to slice tho Rncf-Schmitz case in half In passing on the matter Judge Dunno said: ''I am not unfamiliar with the tac-tics tac-tics emplo3ed by counsel defending tho co-defendant here, and I have also noticed that they invariably appeal to Judge Graham as a man of large sympathies sym-pathies and generous impulses. That judge has found it necessary and proper pro-per to interfere in the past with the orderly conduct of this court, and in that, connection and in connection with tho proceedings now before this court it seems to me that. I ought, not to bo called upon to do an idle and useless thing. In other words, I ought not to bo compelled to proceed with this inquiry in-quiry in the present condition, becauso if the application of the counsel should' appeal to Judge Graham I want it understood un-derstood that both cases will be sent to him. I cannot proceed under tho very circumstances of the case with the hearing of this matter with regard to tho detendant Ruef, and I would not feel justified in so doing, I submit the matter to you.
