Show SUES CITY MARSHAL. George E. Lyon Alleges That He Was Imprisoned for Debt. Marshal Michael Mauss of Murray and Charles Brown aro made defendants In a. suit for 5C300 damages In tlie District court. One Georgo E. Lyon of Ephralm is tho plaintiff, and claims ho was arrested ar-rested by Mauss for a debt. Ho charges that the defendants conspired to injure ids cood name and to cause him to bo lniprl8oned. Lvon, Mauss and Brown. It Is alleged, wero all Indebted to tho Stato Bank of Murray for $50. Lyon was the principal on a promissory noto, Mauss and Brown were sureties. Lyon says that the others oth-ers swore to a complaint beforo Justice of the Peace McOmle charging tho plaintiff plain-tiff with bavins obtained tho signature of Charles Brown by false pretenses. Lyon says they acted without any Intent to conduct a criminal prosecution, but lor tho purpose of collecting a debt. Marshal Mauss, It Is alleged, put hand-suffs hand-suffs on Lyon's wrists and caused him great pain and suffering. Ho says that the Murray Jail wa3 without with-out heat and in a filthy condition. All the tlmo he was In jail, no says, ho was subjected to threats and lndlsmitlos to Intimidate him Into satisfying the dolus. Finally he yielded to coercion, took a job at Murray and turned over his wages In satisfaction of the note. When he agreed to do this, the defendants caused him to be released from Jail. Because of this alleged conspiracy Lyon asks $5000 actual damaces, and for exemplary ex-emplary damages, $1500. |
