that the housp had its usual cat and dog time After the regular session began the members of the majority split on the election of the minor officers of the house and at the time of adjournment had got no farther than the speaker ad the chief clerk House bill No1 providing for a time when the legislature should meet in regular session passed the senate with au amendment fixing the time at 4 oclock yesterday afternoon was concurreQ in by the house shortly afterward af-terward and was signed by the governor gov-ernor immediately after being presented pre-sented This means that balloting on f United States senators will not begin r until the 21st The legislation needed fcv the courts can in the meantime be altrnded to a condition for which the I ineonle owe a vote of thanks to the action ac-tion of the minority in the senate A bill was introduced in the lower house yesterday afternoon provIding 3or the terms of the district courts and fixing the qualifications of jurors Representative Rep-resentative Nve had the honor of introducing in-troducing this bill which is virtually the first one of the session either special or regular the house bill passed yesterday being a measure of expediency expedi-ency pure and simple SENATE I The session of the senate yesterday t a absolutely devoid of anything TvhicQi might be construed a sensational sensation-al the only approach being the objection 4 objec-tion of Senator Jones of Salt Lake to the placing of a telephone in the senate committee room and which shall be used by the members free of cost including in-cluding the use of the lines outside of the city Jones intends introducing some bills which will affect telephone and telegraphic companies and did not want to be under obligations to any of them for courtesies He stood alone however and when the vote of acceptance accept-ance was taken was the only member of the senate who cast a vote against the proposition The senate parsed house bill No 1 yesterday and passed from special to regular session at 4 oclock This is a vict < iry for the Democratic minority because it means that the balloting fur United States senators will not begin be-gin until Clip 21st In the meantime some legislation In the interests of the courts can be had and several other needed statutes passed Roatme proceedings of the session were as follows THE PROCEEDINGS At 205 President Cannon called the senate to order and invited Senator Zuidel to offer prayer which was fol lowd being present by the roll call all the members Senator Jones directed the attention of the chair to the presence of Senator Sutherland and suggested that he be sworn in The oatn was administered by the chair and Senator Sutherland took his set Senator Jones called up house bU No 1 an act providing for the convening conven-ing in regular session of the legislature legisla-ture of the state of Utiah and offered ar Amendment providing for the con venjng of both houses at 4 p m on Tuesday January 7 Senator Miller of Salt Lake displayed p degree of anxiety lest the measure fail ir eftec became it could not be passed in time to publish but was reassured re-assured by Senator Jones who stated that if n twothirds vote of both houses vas cast in favor of the bill i would stand stHdDEMOCRATIC DEMOCRATIC VICTORY On roll call all members of the senate voted for the bill I was observed that the Democrats were somewhat elated and well they might be a in the defeating de-feating of the bill a it came from the house they h a scored the first victory I vic-tory in the first legislature of volunteered the information that the bill would be engrossed and sent to he governor as soon a signed by t > be president of the senate which piece of news brought Senator Boot of Salt Lake to his feet with the statement state-ment that when it came from the house I should be acted upon by the senate Inasmuch a there were no committees commit-tees he would move the appointment of a committee on enrollment and en jcrottssne of oills and suggest hat I the senate as committee of the whole a cmmite attend at-tend to that duty Senator Snow thought this method too cumbersome and moved the appointment ap-pointment of a committee of three for the work which was agreed to and Senators Snow Sutherland and Glen Miller were appointed to look over the measure when it was returned Irom the house The senate then took a recess re-cess of fifteen minutes to await developments FIRST LAW PASSED Upon reconvening the chair announced nounced the engrossment of the bill by the house and referred it to the special committee which a few moments later la-ter announced to the senate that it was all in due form and ready for the signature signa-ture of the president In the presence of the senate he then signed it and ordered it sent to the governor for his approval The chair tool the pen which he used in this work and will carefully preserve it as a memento of the occasion it being the instrument with which the first measure passed by the legislature became a law The senate took another recess until 4 oclock when the information was brought in that the governor had the bill in his possesion This was a signal sig-nal for Jones to move that the secretary secre-tary announce to the house the readiness readi-ness and willingness of the senate to adjourn its special session sine die The motion was agreed to and having nothing else to do the senate decided to hear the journal of the previous day Minute Clerk Clove had omitted three or four matters but after a time everything every-thing was adjusted and the senate listened lis-tened to a committee from the house which dropped in to inquire if there was anything else the senate had to do in which the assistance ot the house was required Senator Miller of Salt Lake there Mier upon introduced a joint resolution that each house appoint a committee of three to wait upon the governor and inform him that both houses were ready to adjourn GOVERNOR SIGNS THE BILL Senator Bocth raised a point of order or-der that the bill passed by the senate and house had not yet been returned by the governor which point was held to be a valid one Representative Tom Fergusson one of the committee volunteered vol-unteered the unofficial tidings that the governor had signed the bill and that the same was in the possession of the house Senator Jones deemed this sufficient notice and moved that the senate notify the house that it was ready to adjourn While the secretary was writing out this missive the house notified the senate sen-ate the governor had signed the bill Mr Evans moved the senate adjourn sine die and ten votes were cast in favor fa-vor of the same when Snow raised a I point that the journal of the days proceedings pro-ceedings had not been read and that the regular session had no power to receive re-ceive and correct the minutes of a special spec-ial session Booth took a opposite view while Miller of Salt Lake held that Evans position was correct Allison moved the appointment of I < committee of three to examine and correct cor-rect them which carried and the following follow-ing senators were chosen Evans and R G Miller On motion of Senator Evans the sen I ate adjourned the special session sine die REGULAR SESSION Secretary Pardee called the regular session to order a few minutes after the special session adjourned and called the roll All the members answered an-swered their names after which Senator Sutherland nominated George M Cannon Can-non for president of the senate Senator Snow placed R C Chambers in nomination for the position The vote was a strict party one a I on the day previous Cannon 1 Chambers Cham-bers 5 Cannon and Chambers paired on this vote Upon taking the chair the president said there had been a question raised a to whether the members had to be sworn in again He had looked up the law and found that they were elected to serve one year Hence he did not deem it necessary The officers of the senate however would have to be sworn in again Evans moved the election of the officers icers of the senate as presented by the Democrats yesterday including a chap lain and a docket clerk This was amended by Booth omit ting chaplain and docket clerk and adding ad-ding a janitor The amendment prevailed a a viva voce vote the Democrats voting solidly solid-ly against it The Democrats then presented the list of their candidates as offered in the special session as a amendment to a motion by Booth that the list of Repub ican officers elected be made the officers offic-ers of the regular session with the addition ad-dition of Theodore Chidester a janitor The amendment was lost by a strict party were declared vote and elected the Republican officers I The officerselect were then sworn in and at the suggestion of Senator I Jones Senator Evans offered prayer Senator Jones moved the secretary notify the house that the former body I was in regular session and ready Co do business This was agreed to and Mrs Pardee wrote another letter Senator McKa < moved the appointment appoint-ment of a committee of three to wait upon the governor and tell him the senate had established itself and was ready for action Booth objected He wanted a joint committee from both houses The legislature notifies the governor that Its It-s ready for business not the senate or the house said Booth We should have a joint committee and not a little one horse affair of our own Booth then wrote out a resolution which was sat upon by the senate and the orig inal motion carried McKay Snow and Allison were appointed to seek out the executive the senate and tell him of the action of RULES ADOPTED While the committee was out looking up the governor Chidester moved Roberts rules of order be adopted byte by-te senate until suoh time as a committee com-mittee on rules should be appointed and make a report This was too deep for the majority and an amendment by Sutherland was offeredsubstituthig the rules of the last legislative council which was adopted The sergeantat arms was instructed to procure the rules and also a copy of the constitution ator constitu-tion and the enabling act for each sen THANKS FOR THE ROOM Miller of Salt Lake was grateful to the mayor and the council for the free use of the room and as a compensation compensa-tion therefor moved they be tendered a vote of thanks and to be given the to privilege of the floor This was agreed THE GOVERNOR ESCAPES Senator McKay chairman of the committee com-mittee appointed to hunt up the governor gov-ernor reported at this juncture that the executive had escaped from the building and was up town Senator Allison arose to remark that he had secured a hearing by telephone and that the governor desired to submit a communication to both houses in joint session today at 3 oclock FREE TELEPHONE This was received without any manifestation mani-festation of surprise and the senate listened to the reading of a communication communi-cation from David Murray superintendent superin-tendent of the Rocky Mountain Bell Telephone company tendering the use of a telephone free of charge and the use of outside lines and asking where the instrument should be placed Jones of Salt Lake objected He was going to introduce some bills later in the session which might interfere with telephone and telegraph lines in a way and he did not want to be under obligations gations to any one in this matter Miller of Salt Lake declared these favors were tendered and accepted in Washington and other places and there was no harm o the part of the senate in accepting The company tendered the telephone to the senate not the individual dividual members thereof The offer was accepted and a vote of senate adjourned until today at 2 oclock I is expected that President Cannon Can-non will today appoint the senate committees com-mittees rH HOUSE The house was called to order at 2 oclock Rev T R G Welch offered prayer and the minutes of the previous previ-ous days session were read properly amended and approved Gibson Democrat of Uintah men proceeded to stir the house up a little on rules The smoking contrary to the rules adopted which was indulged in the day before was again gOing on and he did not like I He raised the point that it was an infraction of the rules and informed the house that if it continued he would have to withdraw A communication from the senate announced that H B No1 passed the day before had been reconsidered and amended and asking the concur rance of the house in the amendments Critchlow of Salt Lake moved that the house concur in the senate amendments amend-ments Harris of Weber asked that the amendments be read but the speaker ruled it was not the proper thing to do until they had been concurred con-curred in This was the first of a series of ridiculous rulings on his part which continued throughout the afternoon after-noon Critchlows motion was put and the Republican majority arried it The speaker then instructed the cleric to read the amendments and the house was given an idea of what it had been voting on The amendments changed the time of the convening of the regular session from 6 oclock Monday to 4 oclock yesterday Speaker Dennys next move was to declare the bill to be on final passage and lie called for the ayes and nays The Democrats in the hope of getting the matter out of the way good na turedly voted with the Republicans rather than take up more time I Even with the sneakers extraordinary extraordi-nary precaution there was still an error er-ror in the proceeding for the house repeated its action of Monday and forgot for-got to take the vote on the emergency clause There is a possibility therefore there-fore that the bill is of no avail since it was passed especially to legalize the immediate convening of the legislature legis-lature in regular session and the constitution con-stitution expressly states that no set shall take effect until sixty days after the adjournment of the session at which it is passed unless the legislature legisla-ture by vote of twothrds of all the members elected to each house shall I otherwise direct I Of course the house may by resolution resolu-tion direct that the journal be made I to read that the emergency clause was agreed to by a twothirds vote or I the point mav be made that as there I was no objection raised the emergency clause was accepted by unanimous consent SEATS CONTESTED Thorn of Utah presented petitions contesting the seats of Representatives Lemmon Smoot and Larsen of Utah On motion of Critohlow of Salt Lake Thorns resolution that they be received receiv-ed and filed to be taken up at the regu ular session was laid on the table At this point a communication from the senate was received announcing that H B No1 had been enrolled and engrossed and signed by the president I was discovered that the history of I the bill in the senate had not been placed on the bill and it was sent back for this requirement While the house I was waiting for its return Thorn moved that his resolution with reference to contested seats be iken from the table The motion was agreed to and the resolution authorizing the filing of the contests for consideration of the regular session was adopted A communication from the Telephone company offering to put in three telephones tele-phones for the use of the house without cost was received from General Superintendent Sup-erintendent D S Murray and on motion mo-tion of Taylor of Salt Lake accepted A message from the senate announced announc-ed that the history of H B No1 a been attached as requested and the bill was at last declared ready for the wa lat declare redy governors gov-ernors signature and a special committee com-mittee was appointed to wait on his excellency An informal recess wins taken and at a few minutes before 4 oclock a communication from the governor gov-ernor was read announcing his approval ap-proval of the first act passed by the legislature of the state of Utah Harris of Weber moved an adjournment adjourn-ment but withdrew his motion when informed by CritchJow there was more business before the rhnn < w Condon of Weber introduced a batch of resolutions and without n motion I I for the adoption of a single one of them the speaker would announce at the conclusion of the reading you have heard the reading of the resolution resolu-tion those in favor will ton thoe wi signify by say ing aye those opposed no In this fashion they were all carried the speaker declaring after each one that the resolution was adopted The Democrats Dem-ocrats took no part in the voting but laid back in their seats and laughed One of the resolutions provided that the minutes of the special session be transcribed in the journal of the regular reg-ular session and the other provided for the appointment of a committee to wait on the governor and inform him that the special session had finished its labors and to ask if he had any communication com-munication to make and the appointment appoint-ment of another committee to inform the senate that the house was ready to adjourn The former committee was composed of Condon of Weber Gibbs I of Box Elder and Nebeker of Rich I and the latter of Ferguson of Carbon Thorn of Utah and Howard of Emery I The committee sent to the governor returned with a message from the I chief executive informing the house I that he had nothing further to communicate com-municate and thanking that body for 1 its prompt action and the admirable I manner in which i had discharged its part of the duties for which the special session was called A mesage from the senate informed the house that the senate was ready to adjourn and then began a controversy over the proper method of adjourning which lasted until long after the hour fixed for the convening of the regular session by the bill which had just been passed The culmination of the culminaton controversy con-troversy together with what followed has the effect so some claim of giving the state two distinct sessions of the I legislature both in progress at the same time for the special session was never adjourned while both branches have organized for the regular one The constitution distinctly provides that at no session of the legislature shall either house adjourn without the consent of the other for more than three days The proper procedure therefore it is asserted is the passage of concurrent resolution a < Tesoluton adjourning the two houses when a session Is at an end This was attempted by the introduction in-troduction of such a resolution but a usual no motion that it be adopted was made but instead the sea ordered the resolution read a usual then said You have heard the motion all in favor signify by saying aye those opposed op-posed no This action deprived the motion of its form of resolution and brought the question upon a simple motion to adjourn which was carried A puotracted discussion as to the propriety of such action ensued which was participated in by numerous of the new members anxious to display their knowledge of parliamentary practices None of them seemed to know where they were at however and the speaker was more at sea than any one Lewis of Salt Lake alone appeared to be aware that a concurrent resolution resolu-tion must be read three times before passed and he was not sure of i but thought so and asked for information on that point I The chair ruled that in any event it I was too late since the motion to ad jour had carried already The house alrea5y was in a most hopeless state of confusion con-fusion with no question before i and everyone talking at once when Caziar of Juab arose and informed the chair that nothing further could be done since the house had adjourned and there was no speaker to put a motion Finally the members left their seats congregated in groups and chatted on other affairs forgetting the business of the hour They had simply given up all effort to find a way out of the muddle mud-dle At length the speaker and a few others decided to send a message to the senate to the effect tht the house had passed a concurrent resolution to adjourn and one was fixed up and dispatched by a messenger who returned re-turned and informed the members of the house that the senate had already adjourned and had reorganized in regu lar session Speaker Denny thereupon arose to the emergency and resuming the chair he had vacated declared that he adhered to his original decision and out that date the house stood adjourned with In Regular Session When J the house emerged from the adjournment it proceeded to reorganize reorgan-ize for what is termed the terme regular session ses-sion but it was much more like a irregular ir-regular one After a long and exceedingly exceed-ingly tiresome wrangle in which much more time was frittered away toe house was organized by electing the officers selected by the Republican caucus cau-cus and who officiated at the special sessipn Presley Denny speaker and William Thompson chief clerk the Democrats presenting their presentng caucus nominees with Aquilla Nebeker for speaker and George Christiansen for chief clerk When the speaker had been escorted to the chair by Nye and Critchlow I Lewis moved the adoption of One rules of the thirtyfirst territorial session govern the session The motion prevailed pre-vailed After some discussion to no point over the necessity of legislators again taking the oath Nye introduced the first bill in the regular session Its reading w laid over pending more discussion with no point as to whether a bH could be introduced until the house was fully organized A communication commu-nication from the senate announced that it had completed organization A motion to adjourn by Harris was lost and then Monsoji took advantage of the Republicans not being ready to fill the minor offices and offered a resolution res-olution naming Democrats for the places The resolution was of course promptly laid on the table by the Republican majority The house decided de-cided to consider itself organized after af-ter i had been transacting business for an hour and sent a message to that effect to the senate and then Nye called for the reading of this bill which is verbatim as follows H B No 1By NyeAn act to provide for the fixing of terms of district dis-trict court and the summoning and determining de-termining qualifications of jurors therein Be it enacted by the legislature of the state of Utah Cection 1Until it shall be otherwise of provided by law the district courts the several judicial districts of this state are hereby authorized to fix the terms of court to beheld in each of the counties of their respective districts and to issue open venires for the summoning sum-moning of jurors to try all civil and criminal business arising in the several sever-al counties of each district and tria countes ble by such courts Sec 2Until otherwise provided bylaw by-law the qualifications of jurors shall be as follows IA citizen of the United States over the age of twentyone years 2Who ca read and write the English Eng-lish language 3Who reside in and has resided in the county in which such juror is called upon to serve six months next preceding the time such juror is so summoned summone 4Who is a taxpayer in this state and 5Who is of reputable sound mind and discretion and who is not so disabled dis-abled as to be unable to serve All acts and parts of acts in conflict with the provisions of this act are hereby repealed Sec 3This act shall take effect immediately im-mediately from and after its approval The author sooke in favor of his bill and asked that it be passed at
