finished last evening and the defense ope J > ed up this morning at 10 oclock The evidence given by the prosecution vas somewhat of a boomerang I went to show that the greater number of errcis made were more in favor of the contestants and against the con testees In one instance where it is alleged that a certain youine man was j nonresident and voted which was a illegal if true the yo ing man father 1S i testified that the boy as he called I hlmi led in the same town that he Toted in and that he was entitled to vot In nearI every instance where i is alleged that parties voted wrong lully it was shown by the evidence for thk contestantsthat they were en titlPd to vote just where they did vote tted W F Yvtesomb of Springville testi lied that he was present at the polls in Spnngville when the votes were counted count-ed and saw a Republican ticket with a sticker on W 0 M Roylances name being on the sticker The sticker coy rred the names of Simons Bringhurst I Thorn and Graham completely covering cover-ing the name of Thorn and leaving I arts of the oth r names to view This cte was counted for Roylance and against Thorn Graham Simons and TJrlnvjjhursts names were counted on this ticket This VP < the only thing which could be objected to by the eonttstants and tins W in their fa j m William Roylance testified subi nantially the Fame as the previous vtnfcss Was present at the counting jf the ballots Assisted in the tally t > v request of the judges Of election tVitnoss made n diagram of the bal lnL above mentioned showing the position po-sition the Roylance sticker was in Witness said that ali that showed of Grahams name was ham This is quite baggy but true in its literal lit-eral Kvnse The vote however was y xunteii for Graham yet he contests I the election on this showing o Jaraes E Hall assdssdr of Utah I county testi ieil substantially the f ome a abel abe-l to the Mapleton election which the Republicans are trying t throw nut it is all a bluff on their part It is now a 1 was on the day of election n rand tand play Some of the Ma pleton ters were ordered by the Utah commission to cast their ballots bal-lots in Springville because they lived in thf corporate limits of the city I IIho IfcppuWicar1 ward heelers chzjj lenged every one of these who were Democrats and succeeded in intimidating intimidat-ing six Democrat and prevented them from voting Later in the day the Republicans run in eleven voters < r > f Mapleton who reside in the corporate cor-porate limits of Eipringville and voted every one of them After doing all this they now cry fraud fraud The people of Mapleton are disgusted with the way the Republicans are proceeding There is not an honest mar in the town but who says the ejection ejec-tion was perfectly straight and according accord-ing to law The Tribune rsfor to it as a black spot in the history of Utah It is right Republicans hay mad tIle black pot and are now making it blat ker by showing their aide in its tr light The true inward workings of the Republican party if brought to light would be so black it would put the light < It According to the evidence evi-dence before the special commissioner J the Republicans tried their best to steal the election in Utah county by intimidating Democratic voters They failed in their scheme and now think they can steal it by crying fraud and ask a Republican legislature to believe their allegations of fraid and seat three men whom the people have said 1 > y their ballots they no not want Their motto is HI the people vont elect us we will elect ourselves SUMMARY c At Lehi there were five state ballots found at nol No 2 in county box two straight Democratic two straight Republican and one Republican with l candidates scratched except TJartch Wells and Chipman These ballots were not counted At poll No 1 in Lebi there were three state ballots bal-lots in county box two Republican v and on Democratic There were enough ballots without these to tally with the voted list and they wit lst were not counted At Highland precinct one state ballot was found in county box it was Republican and i straight Republcan counted coun-ted At Pleasant Grove there were 4 two straight Republican state ballots found in the city box They wore counted At American Fork there were two straight Republican state ballots found in city box They were not counted At Provo First Ward there was one straight Democratic state ballot bal-lot found in the city box I was not counted I Provo Second ward there was one state ballot straight Democratic found in city box not counted In Provo Third ward there were three state ballots found in city box two straight Republican and ont L straight counted Democratic They were all In Springville there was one Repub lioan state ballot scratched by pasting past-Ing the name of W M te r Roylance over the names of J F Brln hurst J T Thorn and J C Graham in such a manner as to completely obliterate the name of Thorn and a far obliterate the names of Graham and Bringhurst as to make them completely tlem unrecognizable unrecog-nizable The ballot was counted for Rovlance and all the Republicans except ex-cept Thorn As regards the illegal vot ing the only proof mae by the Republicans Repub-licans was against Eli Robinson Thomas Thom-as Lloyd jr Ephraim Rowe E S Cowley John W Pike and Jonas Schow Robinson was born and reared in Spanish Fork has a home and blacksmith shop there and pays taxes thereon has a wife and family and for about a year and a half has been working for another Spanish Fork man at Mammoth He has worked for wages by the day a a blacksmith has never voted anywhere else hut Spanish Fork and holds his place there as a residence Lloyd i turns out did not vote the state ticket but out Republicans Re-publicans swore he did The fact is his name was not on the state regis tration list At any rate he Is 3 Spanish Fork boy born and raared there his parents par-ents reside there now he is unmarried and makes Spanish Fork his home when not off at work for wages The same facts are true a regards Rowe except that Rowe voted the ticket E S Cowley married testate Provo girl lived in Provo until a short I I time before the election when he went away t find work taking his I young wife with him leaving his household furniture and a large per tion of their wearing apparel at their r i home in Provo The things are here at present and Cowley is at present in S l Lake with his wife occupying furnished rooms His absence from Provo is considered by his wifes mother and stepfather a only temporary tem-porary John W Pike was prior to the wa pror 4th day of January this year official stenographer of the First district court He had his office room in the court house building in Provo up to that date carried the key and had sole control of said office Just a few days before the election he moved his family fam-ily to Salt Lake City but he himself continued In Provo performing his official duties visiting his family occasionally casionally as his duties would nermit Schow lived in Lehi has a house and lot there and furniture in the house also has cows and horses In Lehi being be-ing taken care of by his brother For the last five or six months he has been working in Mercur His family is there with him As against this showing show-ing of alleged illegal votes the Democrats Demo-crats have shown at least three or four illegal votes cast by Republicans because found Every ballot rejected becuse in the wrong box was rightly rejected and every one of such votes that was counted was wrongfully wrong-fully counted hence a careful examination of the above will show that at lest four ballots were counted for Republicans that ought to be deducted de-ducted from the returns of this coun tv and the Democrats receive the benefit ben-efit of the deduction This with two eft < I more votes which i seems probable the Democrats will make when Republican Re-publican illegal votes are thrown out will elect Roylance and unseat Thorn the only Republican in the legislature from this county A contest by Spy lance against Thorn would be carrying the war into Africa but nevertheless would be dead right Graham looks down in the mouth and Republicans generally are either discouraged or disgusted All of the state ballots above referred re-ferred to found in the wrong box were in city or county envelopes thus showing that the mistake was marie by the voter and not by the judges of election At 3 D m the evidence was all in and the farce came to an end I to legislature will now remain for the legislature wi decision decide There can be but one and that is that the contestants have no cause of action MASQUERADE BALL There will be a grand masquerade ball given in the Provo opera house on Jan 23 The ball promises to be a swell affair A number of Salt Lake parties will come down for the occasion occa-sion wi Park City Opinion PARK CITY Jan 15 Much interest yester was shown by our politicians day when The Herald was read with the communication of Heber J Grant on the senatorial question Democrats their of Park City who have expressed stand Mr sentiments in regard to the sentments Grant has taken in the interest of Hon George Q Cannon oppose it to a man as an indefensible political expedient in legis to ask of the minority our nominees lature to desert the partys Sentiment though i may be yet the people who elected their representatives representa-tives to the legislature expect a faith tves in ful adherence to the wishes which vital importance for of such a matter vial n the future of Democracy in this state cannot afford to disintegrate the cohesive co-hesive strength of the party even for such a commendable purpose as Mr Grant suggests Consistency of principle prin-ciple in the fulfilment of pledges should be the incentive of every loyal Democrat Demo-crat to stand by their declaration as voiced in the convention Vascilation on the part of the Democratic members I of the legislature will appeal with an irresistible foTSa of the people that things are not as they should be dissatisfaction dis-satisfaction as well a disaffection will I be the legitimate result of such a course The sentiment that Mr Grant I refers to is a vital living force among all good Democrats who have honored Mr Rawlins and Mr Thatcher in such a signal manner To them was tendered ten-dered the ardent support of the Democrats Demo-crats of Utah the honor of representing represent-ing them in the most august legislative legisla-tive body in the world the senate of the United States I is good judgment judg-ment good principle and good politics to for our minority representation stand by their nominees even though certain defeat be their portion Brav is attribute ery and unflinching courage an tribute of immortality in the hearts of our people discouragement fear of I results and lack of energy is i anything j any-thing the most condemned among a progressive and n brave people A firm stand can now be made that will be an object lesson for the rising generation gen-eration a marathon in the elevation of Democrats to principle What care the Democrats for the internecine strife among the senatorial candidates in the Republican ranks With an aggressive and solid front the minority united can deadlock the legislature and n counter combination could easily be effected to insure the election of one Democrat to the United States senate Such a man can easily be found who by his standing stand-Ing in the good wishes of the people of the state would be acceptable to the majority and by such means obviate the drastic course that does not meet with favor that of Mr Grant There are men in the Democratic party who have rendered as good service to the people of Utah a either George Q No inconsiderable Cannon or O J Salisbury siderable opposition would have to be neutralized to make the election of either of the gentlemen named Political Po-litical convenience and charity should begin at home abundant material for senatorial timber is within the Democratic Demo-cratic ranks and can and should be cratc utilized with proper direction Unless all signs fail opportunities will not be wanting with due vigilance and firmness for the Democrats to capture the persimmon owing to the lack of political stature on the part of the Republican Re-publican candidates The further progress of the senatorial fight will be watched with unabated interest Firm ness and watchfulness should be the incessant care of the Democratic members mem-bers of the legislature the people have an abiding conviction that they will discharge their trusts to the eminent satisfaction of their constituents The funeral of William Watson will take place from Heber City at 1 oclock this afternoon from the
