Show I r m Ft RVERS CONTEST Republican Attempt to Capture the Mayoralty PAPERS ALL DRAWN UP GROUNDS OP THE CONTEST FULLY SET FORT Alleged That Driver Ballots Were Wrongfully Rejected By Judges and Illegal Ballots Were Accepted Clam That Fourteenth District trict Should Be Thrown Out The longexpected d muchtalkedof election contest is expected to materialize material-ize At least four attorneys have labored la-bored on I and have prepared a docu ment to file in the district court today which a few people hope will seat Driver Dri-ver in place of Boyle in the mayors chair nest year From talk with witnesses wit-nesses and others interested in the case The Herald can say about what lines the attorneys will wage the contest con-test on The complaint to be red today it is said will be entitled William Driver contestant vs John A Boyle con testee and will admit that the city council as a canvassing board ha duly declared Boyle elected The first few allegations will of course deal with setting forth the well known facts about the election Boyle being the I Democrat and Populist nominee and Driver the Republican The complaint I was drawn to be sworn to by William Driver and among the allegations are I these I That the judges of election in the First election district rejected two legal le-gal votes that were cast for Driver that they returned only o3 votes as j i voting for said Driver when in i truth Ion I I de and nl in fact they should have entered on the tally sheet 57votes That the election judges in the Sixth district rejected 15 votes which were cast and polled for Driver and placed on the tally sheet as voting for him only 67 votes when they should have returned as voting for him 82 votes I is to be claimed that one or two Illegal votes were cast for Boyle in the Eighteenth district that there were similar irregularities in the Seventeenth Seven-teenth and in the Twentyfirst and that one or two ballots for Driver were not counted for him in the Thirteenth and in the Twentythird districts I will be charged that John Josephs voted in the Seventh district though he was a nonresident that D C Mc Gill did likewise in the Twentythird district being a resident of some other district Charles R Hood it will be claimed did likewise in the Sixth but that he was not a resident of Ogden Moses Dumas and Samuel Howard it is to be claimed voted illegally in the Sixth All these votes it will be claimed were for Boyle COUNCILS MISCONDUCT The city council sitting as a canvassing can-vassing board are to be charged with errors and misconduct sufficient to set at naught tile will of the majority I Among the alleged errors I will be charged That in canvassing the returns and i in declaring the result the board of I canvassers canvassed what purported I to be the returns from the Fourteenth election district i when in truth no tally I lists were returned from said election district by the judges signed or certi I g Jrbci yt j sg errt = fled by any judges in the manner required I re-quired by law or in any manner at all lj The board declared that Driver had received 61 votes in this district and Boyle had received 111 that if the tally sheet had been rejected by the board of canvasser as i should have been It would have changed the reult The canvassing board declared that Driver received a total of 2219 votes when I should have declared that he had received a total number of votes of 2150 and that said Boyle had received a total number of votes of 2267 when it should have declared that he received a total number of votes of 215G and it declared that Boyle was elected to the office of mayor by a majority of IS votes when it should have declared that Driver was elected to the office of mayor of said city by a majority of 30 votes On account of these things and several others the court is to be asked to declare de-clare Boyle elected Among several attorneys at-torneys who have worked on the com plaint are James N Kimball John D Murphy J B Bagley and L R Rogers Tomorrow is the last day allowed by law for filing the suit |
