Show MOTHER SUES WIPE SETTS Rater Unque Suit Isttted at Provo Special Correspondence Provo Nov 29A complaint waS today to-day fed with the county clerk by Violet Uric wherein she begins suit against the Rio Grande Western Railway company I for the sum of 1000 For her cause of acton plaintiff alleges that her son Geocae 1oett Uric was in the employment employ-ment of defendant as fireman on a ieee Ifl 1re motive engine at Clear Creek and that on Nov n 196 he was directed to ride upon an engine that was disabled and unsafe and known as a dead engine that I knew the engine when coupled wIth other cars engne rn at a high rate of speed would swing and sway from side i to side that It failed to keep a proper lookout over said engine and a a result thereto sad fireman George Loyet Uric I was thrown from the engIne with great force and violence and killed Margaret Uric wife of the deceased is made corespondent in thifl case because she refuses to join with plaintiff in this cause of acton she having received 75 as a settlement for her claim against the railroad company The company sets up that the sum of 750 was pad to her a a compromise and t avoid controversy and in view of her relation to the deceased and not for any of the alleged wrongs or any wrongs Defendant Is represented by Bennett Harkness Howat Bradley and Richards Pardee and Plaintiff is represented by Power Straup Lippman The iento of tile district court was today taken up in hearing the arguments I in he case of Hincldey vs Pony The case wa submitted at a oclock Judge William H ICing was here yesterday yes-terday and today as counsel for the I plaintiff In this case |
