Show TAX LIST PUBLICATION The Matter Aired Before Judge Rolapp The mater of the publication of the Weber county tax list came up before Judge Rolapp yesterday on the hearing hear-ing for an injunction Drayed for by William Clasman to restrain the county treasurer and count commissioners commis-sioners from awarding the contract to the Weekly Press Chairman Armstrong of the board of county commissioners was the first witness he being caled simply to prove that Mr Glasmann had made the demand de-mand as claimed Treasurer Chambers then testified as to other facts on the proposed award and said he had seen a copy of the Press but knew nothing of Its circulation circula-tion Mr Tomas manager of the Press Publishing company was next called to testf as to the circulation of the paper After some questioning the plaintiff desired the introduction tif the books and though this was opposed hJ the defendants counsel the judge overruled them on the maters and the boos were sent for Subsequent evidence was to the effect ef-fect that the circulation of the Press was about 200 which Manager Thomas claimed was distributed generally over the county The case was argued at a night session ses-sion the contention of plaintiff being that the Press did not meet the requirement re-quirement of thelstatute not being a paper of general circulation and also being a weekly paper ten insertions would reaulre ten weeks more time than will intervene before the beginning begin-ning of the safe I was contended that the term ten issues meant ten consecutive consecu-tive issues Judge Maginnis fQr defendant maintained main-tained that insertion for ten days I meant insertion for ten times in every issue of the publication for ten dfiys and that general circulation means general in a geographical sense Taken under advisement until Thursday Thurs-day morning |
