Show YOUNG WARNERS POLICY Judgment Against tho Suritics of the United Mates Mutual Powers Riles argued a motion for judgment against the surities in the case of K T Pettingill administrator of the estate of J Harley Warner deceased vs the United States Mutual Accident association associ-ation in the Third district court yesterday morning which was sustained The judgment was prayed for against tho sur ities on the following grounds That on March 13 183 the judgment of the Third district court was affirmed by the judg ment of the Supreme court and that the appellant the United States Mutual Acci dent association has not within sixty days thereafter filed any citation writ of error supersedeas bond or transcript tran-script of the record on appeal to the Supreme Su-preme court of theUnited States further that on Nay 3 1893 the clerk of the Supreme Su-preme court by his certificate and re mittitur duly certified to the cloak of the Third district court the judgment of the Supreme court and that more than thirty days had elapsed since such remit titur In this case the United States Mutual accident association was sued by the administrator ad-ministrator of JrHarley Warner deceased de-ceased to recover 5000 which said sum represented insurance on the young mans life Young Warner came to his death in a mysterious manner and the insurance in-surance company refused to pay the pol icy on the ground that he committed suicide The case was tried before Judge Anderson in the lower court and on April 28 1892 judgment j was rendered against the defendants for 5532333 and an appeal was taken to the Supreme court where the judgment was affirmed on March 13 of thepresent year On motion of Judge Tatlock attorney for the insurance company a ten days stay was allowed in which a motion to set aside the judgment w l be filed |
