Show I TO PRESENT ThEIR CASE Corwln and Thurjiton Appear Be fore Judge Caldivell St Louis Feb 14John C Corwin special government counsel and John Thurston attorney for the receivers of the Union Pacific railroad arrived here today from Omaha to present to Judge Caldwell of the United States circuit court petitions for relief from the recent re-cent orders made by United States Judges Hallett and Riner Briefs have already been prepared of the voluminous volumin-ous documents principally exhibits In effect the attorneys seek to couple the interests of the government and bondholders bond-holders and secure orders which will enable the receivers to run the system in its own interest rather than that of the beneficiaries of the contracts made before the receivers took hold Two of the leading features of the case as brought up here will be the Julesburg cutoff and the wage scale Thurston said the traffic arrangements arrange-ments of the Union Pacific with the Union Pacific Denver Gulf whereby the former was obliged to run over the Julesburg branch was a contract which cost the Union Pacific 1000 deficit de-ficit yearly Of the Union Pacific Denver Den-ver Gulf Thurston stated he was of the opinion that the traffic arrangement arrange-ment made by the former officials of the road was not binding with the receivers re-ceivers and he is here in the hope of getting a decision to that effect from Judge Caldwell Thurston also holds that the wage schedules made by the former officials of the road are not binding upon the receivers his opinion having been sustained sus-tained by the circuit courts of Nebraska and Oregon and he will try to get that contract overthrown or modified Nothing was done today in the case beyond calling upon Judge Caldwell and asking him to set a day for the hearing National Trotting Association New York Feb HAt the biennial congress of the National Trotting association as-sociation the following dates were arranged ar-ranged for the grand circuit meetings Pittsburg July 9 to 14 if Plttsburg cannot have a meeting East Saginaw Mich will take these dates Detroit July 16 to 21 ClevelandJuly 23 to 27 Buffalo July 31 to August 1 Rochester Rochest-er August 1 to 1 Springfield August 21 to 24 Hartford August 28 to 31 New York September 3 to 8 Philadelphia Philadel-phia 1 to 14 The meeting adjourned to meet in Rochester about the 3d of May 3Vo Change for Some Time Denver Col l Feb 14 Judge Hallett leaves today for the Pacific coast and will be gone some weeks This means there will be no change in the Union PacificGulf situation for sometime some-time to come Nothing has been heard at this end of the proceedings of the appeal by the Union Pacific receivers but the belief Is held that whatever legal steps may be taken the Gulf and the Union Pacific people will not await their issue but will get together to-gether and compromise their differences differ-ences including those with the labor unions Northern Pacific Land Grant Washington Feb 14The House committee on public lands has voted to favorably report the bill of Hartman Hart-man of Montana for determining the title to mineral lands in Mpntana and Idaho within the limits of the land < > grant of the Northern Pacific railroad 1 Under the bill the commissioners to be appointed by the president are to J examine and classify as soon as possible pos-sible all lands within these grants with regard to their mineral charac ter and are to reject all claims on behalf be-half of the Northern Pacific of mineral min-eral lands exclusive of the coal andiron and-iron property The action of the commissioners com-missioners is to be final I It Will TnUe Some Time Washington Feb 14The Senate committee on Pacific railroads continued contin-ued Its hearing in the Interest of the Union Pacific bondholders Boissevain and the attorneys explained ex-plained the proposition for the extension exten-sion of time for the payment of the government indebtedness and answered an-swered many questions put by the members of the committee At the conclusion of the meeting a member of the committee stated that satisfactory progress had been made but the importance of the question time would neces was such that some tme nees sarily elapse before an understanding could be reached The Burlington Will Pay Galesburg Ill Feb 14 There Is no truth whatever in the report sent from here that the Burlington road has postponed pay day I will be tomorrow tomor-row as officially announced a week ago |
