| Show CRiMINAL MATTERS I Fitzgerald Charged With Bribing Brib-ing a V ate Discharged THE MONEY WAS FOR CAR FARE Engineer Johnson Charged With Assault With Intent to Kill Tho Bolton Gate Police Court The examination of Frank Fitzgerald a member of the fire department on the charge of bribing a voter named Gorman at the Fourth precinct on election day was hold before Commissioner Norrell yesterday yester-day afternoon Oscar Wilde Glenn and John Anderson my JoJo appeared for the defendant while County Attorney Murphy prosecuted William S Higham the complaininpTvit ness Was first called to the stand He testified tes-tified that he resided at 76 H street and was at the Fourth precinct polling place on election day In the morning the defendant defend-ant came to the place with Gorman and some other men and the witness heard I Gorman say I want it first Then i Fitzgerald went down in his pocket and gave Gorman some money The witness could not say how much cash passed between be-tween them but it was in small coins Gorman i I I Gor-man then took his place in the line of I voters and after waiting there nation tIme stepped out of the line Fitzgerald at once went up to him and insisted that ho should remain in the line Byron Groo testified that he stood in the Hue of voters and was about three men be hind Gorman He saw the latter start out of the line wneiiFitzgerald came up to him und Enid Get back into the line G d i you What did you take the money for if you wasnt going to vote Alter being admonished in this pleasant manner GORMAX KESCilED HIS PLACE IS THE LIKE Jack Bolton corroborated the preceding witnesse Joseph Patrick a boy testified that on election day he rode over to the polling place on horseback and while standing there he saw Fitzgerald and Gorman talking talk-ing and saw the former put his hand in his pocket but did not observe what he gave Gorman A Higham a brother of the complaining witness testified heard the defendant and Gorman talking at the polling place last Monday What first attracted my attention at-tention was when Gorman said Well you give it to me first Then Fitzgerald put his hand in his pocket and remarked HI will see that you get it and bended Gorman some money I heard it clink but did not see It I did not hear anything said as to what ticket Gorman should vote Mr Murphy here announced that Mr Gibbs a witness for the prosecution was ill and he would therefore have to ask for a continuance Mr GlennState what you expect to prove by him and wo will admit it Mr Murphy Deputy Marshal Cannon can give that information Mr CannonMr Gibbs told me that Gorman THUD TO GET OUT OF THE LINE when Fitzgerald came and said Get back there g d d n you You have got to vote What did you take the money lor if you didnt want to votel Mr GlennOf course we will admit that Gibbs will testify to that or anything else that is asked him The prosecution rested and the defense moved that the defendant be discharged This was overruled and Frank Fitzgerald took the stand He testified I reside at tho corner of Sixth South and State streets On election day I was over at the Fifth precinct when I met Gorman and another man Gorman said he wanted to vote in the Fourth precint I got a carriage car-riage and drove them up to the polling place and was going to return Gorman wanted to ride back but as I had promised to return the carnage down town at once I wouldnt wait for him Then he asked me to give him street car fare and I gave him 20 cents to pay for himself and his two friends Hignt after Gorman started to get out of the line and 1 wont Tip to the polls He said ho couldnt wait for that line of men to vote and I told him to go back as it would only take him a little while to toGET GET TO THE POLLS That is what I said to the man Edward Hayes testified I went up to the Fourth precinct with Gorman Fitzgerald Fitzger-ald and another man on election day While wo were near the line I saw Fitzgerald Fitz-gerald give Gorman four nickels for us to ride down on Mr MurphyDid you hear Fitzgerald say anything about you riding down on the cars The Witness Yes Did Gorman say ha wanted to ride down in the carriage No 4 Did ho ask Fitzgerald for car fare No sir John Gorman was next called and he proved to be a genuine hobo He testified that he went up to tho Fourth precinct to vote and Fitzgerald simply gave him four nickels for himself and his friends to ride down on After getting in tho line he started to town when Fitzgerald came up and insisted that be should remain there This closed the evidence and Commissioner Commis-sioner Norrell said that he would discharge tho defendant as the explanation given appeared to be a reasonable one |
