' A suit of peculiar interest was decided de-cided In the Federal court laat night in which the case of Harris & Co. of South Omaha against the Oregon Short Line railroad was decided in favor of the .plaintiffs and Judgment for $11,369.90 was entered. In 1S99 Bradshaw Bros, loaded some cattle at Mllford and Lund, which were consigned to the plaintiffs in this case. The cattle were to be turned over to the Rio. Grande Western at Provo, but because of weakness they were turned out to pasture at Lehi. by the Bradshaw Brad-shaw Bros. The Rio Grande agent was notified by telephone of the arrival of 'the cattle and he gave a receipt for the bill of -lading but not for the cattle. The 28 head. of cattle have not been ; seen since.- The court holds that the cattle were still in charge of the Short Line when they were turned over to the Bradshaw Bros., -and thd Short Line is held responsible re-sponsible until a receipt for them is received re-ceived from the Rio Grande Western. The Jury also refused to. regard Bradshaw Brad-shaw Bros, as the legal agents of the firm. Other suits have grown out of the same transaction. |
