Show i " An Ordinance AN ORDINANCE LEVYING THE TAX AND PROVIDING FOR THE ASSESSMENTS OP PROPERTY IN STREET PAVING DISTRICT NO. 1, AMERICAN FORK CITY STREETS, FOR THE CONSTRUCTION CONSTRUC-TION OF PAVING IN SAID DISTRICT. DIS-TRICT. BE IT ORDAINEu BY THE CITY COUNCIL OP AMERICAN FORK CITY, UTAH: Section 1. That the City Council of American Fork City, Utah, does hereby levy a tax and provide for the assessment of the same upon the property hereinafter described in Street paving District No. 1, American Fork City, Utah, for the purpose of grading and paving with one inch rock asphalt, surface 18 feet wide, on the following streets in American Fork City, Utah. First South Street extending from 2nd East to 3rd West Street. Second West Street extending from Main Street to 2nd South Street. Construct a surface 16 feet wide on the following streets in American Ameri-can Fork City, Utah: On the North side of the S. L. & U. R. R. track on Main Street extending ex-tending from 2nd East Street to 4th East Street. Construct a surface 12 feet wide on the following streets in American Ameri-can Fork City, Utah: On the South side of the S. L. & U. R. R. track on Main street extending ex-tending from 2nd East Street to 4th East Street. This tax is levied to defray the expense of constructing the above described improvements upon the streets above described in front of the property hereinafter described to be especially affected and benefitted bene-fitted by said improvements and it is hereby adjudged and determined that said property will be especially benefitted thereby to the full amount of the taxes herein levied, and said tracts and parcels of land are hereby assessed in accordance with the linear foot frontage upon said streets to the full depth of said lots. Section 2. All lots, plots and parcels par-cels of land abutting on the aforementioned afore-mentioned streets and which are benefitted thereby as above determined determ-ined are as follows, to-wit: Frontage abutting upon the 18 foot width of street comprises the following blocks and areas: All lots abutting along the South side of Blocks 8, 9, 10, 11, and 12, Plat A, American Fork City Survey of Building lots. All lots abutting along the North side of Blocks 3, 4, 5, 6, and 7, Plat A, American Fork City Survey of Building lots. All lots abutting along the East side of Blocks 7, and 8, Plat A, American Fork Survey of Building lots. All lots abutting along the West side of Blocks 6, and 9, Plat A, American Fork Survey of Building lots. Frontage abutting upon " the 16 foot width of Street comprises the following blocks and areas: All lots abutting along the South side of Blocks 15, and 16, Plat A, American Fork Survey of Building lots. Frontage abutting upon the 12 foot width of Street comprises the following blocks and areas: All lots abutting along the North side of Blocks 13, and 14, Plat A, American Fork Survey of Building lots. The total cost of the above mentioned men-tioned improvements, according to the report of the American Fork City Engineer in Paving District No. 1 which said paving improvements were completed on the 5th day of September, 1940, is the sum of $5,082.00 on 18 feet width Pavement, $1,265.25 on 16 feet width Pavement, and $981.75 on 12 feet width Pavement, Pave-ment, and the abutter's portion of the cost and expenses thereof is the total respective sums on the respective respec-tive widths aforesaid and the cost per lineal foot of abutting property in front of which said paving has been constructed is $0.50 on 18 feet width pavement, $0.90 on 16 feet width pavement, and $0.70 on 12 feet width pavement, and the Treasurer of American Fork City is hereby authorized and directed to assess in accordance with the provisions of this Ordinance and for the purpose above mentioned. The tax hereby levied and to be assessed upon the abutting tracts and parcels of land is $0.50 on 18 feet width pavement per front or I lineal foot, $0.90 on 16 feet width , pavement per front or lineal foot, TRICT." In Witness Whereof, I have hereunto here-unto set my hand and affixed the orporate Seal of American Fork City, Utah, this 23rd day of September, Sep-tember, A. D. 1940. Karl H. That the City Recorder shall deliver to the City Treasurer a certified copy of the Ordinance levying such tax and such Treasurer, Treasur-er, shall, without delay, give at least five days notice in one or more newspapers having general circulation circula-tion in American Fork City of the time when such tax will become delinquent. de-linquent. NOW, THEREFORE, BE IT FURTHER ORDAINED by American Ameri-can Fork City, Utah County, State of Utah, that it Is necessary for the immediate preservation of the peace, health, and safety of said city and the inhabitants thereof that this Ordinance become effective immediately, immed-iately, and an emergency is hereby declared that this Ordinance shall be in effect on the date of Its passage, pass-age, approval, and publication as above specifiad. Bennett, City Recorder of American Fork City, Utah, do hereby certify the above and foregoing fore-going to be a full, true and correct copy of an ordinance, passed by the City Council of American Fork City, Utah, September 23, 1940, entitled "AN ORDINANCE LEVYING THE TAX AND PROVIDING FOR THE ASSESSMENTS OF PROPERTY TN STREET PAVING DISTRICT NO. 1, AMERICAN FORK CITY STREETS, FOR THE CONSTRUCTION CONSTRUC-TION OF PAVING IN SAID DIS- and $0.70 on 12 feet width pavememt per front or lineal foot, of abutting property in front of which said street paving and improvements have been constructed, provided however, that corner lots shall be exempted as hereinafter provided. In making up the assessments, each corner lot will be allowed a reduction of 50 feet frontage where-ever where-ever the pavement herein provided for is constructed around along the full froitage of two sides of said corner lot. Section 3. Said tax shall be payable pay-able in ten equal yearly installments as provided by law and Ordinance, with interest on the whole sum unpaid un-paid at the rate of six (6) per cent per annum, payabls at the time each installment Is due. In the event any installment or the Interest Inter-est aforesaid is not paid on the day I the same becomes due, the whole amount of the special tax unpaid at the time said installment and Interest Inter-est are due, shall become due and payable and shall draw interest at the rate of eight (8) per cent pec annum until paid. |
