Constitutional Amendment No. 5 A Joint Resolutiun Proposing to Amend Article XIII, Section 2 of the Constitution Constitu-tion of the ,-tate of Utah, as Amended al the General Election in 1339 Relating to Taxation of Tangible Property, Ascertainment Ascer-tainment of Value, Exemptions, and th Annual Tax for the State. Be it resolved by the Legislature ol thl State of Utah, two-thirds of all memberl elected to -ach House and two-thirds ol all members of each House concurring therein : SECTION 1. That it is proposed to amend Article XIII, Section 2 of the Constitution Con-stitution of the State of Utan, &. amended at the general election in 1930, to read as follow : SECTION 2. Ail tangible property in the State, not exempt under the laws of the United States, or under this constitution, shall be taxed in proportion to its value, to be ascertained as provided by law. The property of the United States, of the State, counties, cities, towns, school districts, municipal mu-nicipal corporations ajid public libraries, lots with the buildings thereon used exclusively exclu-sively for either religious worship or charitable char-itable purposes, and places of burial not helC or used for private or corporate benefit, bene-fit, shall be exempt from taxation. Water rights, ditches, canals, reservoirs, power plants, pumping plants, transmission lines, pipes and flumes owned and used by individuals indi-viduals or corporations for irrigating lands within the state owned by such individuals or corporations, or the individual members thereof, shall not be separately taxed as long as they Bhall be owned and used exclusively ex-clusively for such purposes. Power plant, power transmission lines and other property proper-ty used foi generating and delivering electrical elec-trical power, a portion of which is used for furnishing power for pumping water for irrigation purposes on lands in the State of Utah, may be exempted from taxation taxa-tion to the extent that such property is used for such purposes. These exemptions shall accrue to the benefit of the users of water so pumped under such regulations as the legislature may prescribe. The taxes of the indigent poor may be remitted or abated at such times and in such maner as may be provided by law. The legislature may provide for the exemption from taxation taxa-tion of homes, homesteads, and personal property, not to exceed $2,000 in value for homes and homesteads, and 300 for per- Constitutional Amendment No. 1 A Joint Resolution Proposing an Amendment Amend-ment of Section 1, of Article VII. of the Constitution Relating to the State Executive Execu-tive Department, the Terms, Residence and Duties of Officers. (Superintendent of Public Instruction.) Be it resolved by the Legislature of the State of Utah, two-thirds of all the members mem-bers elected to each house concurring therein : SECTION 1. That it is proposed to amend Section 1, of Article VII, of the Constitution of the State of Utah as follows fol-lows : SECTION 1. The Executive Department shall consist of Governor, Secretary of State, State Auditor, State Treasurer and Attorney-General, each of whom shall hold his office for four years, beginning on the first Monday of January next after his election, except that the terms of of f ice of .those elected at the first election shall begin when the state shall be admitted into the Union, and shall end on the first Monday Mon-day in January, A. D. 1901. The officers of the Executive Department, during their terms of office, shall reside at the seat of government, where they shall keep the public pub-lic records, books and papers. They shall perform such duties as are prescribed by this Constitution and as may be proscribed by law, SECTtON 2. The Secretary of State is hereby directed to submit this proposed amendment to the electors of the state at the next general election in the manner provided by law. SECTION 3. If adopted by the electors of the state, this amendment shall take effect ef-fect the first day of January next succeeding succeed-ing a determination by the Roard of State Canvassers of the result of the election designated in Section 2 hereof. Constitutional Amendment No. 2 A Joint Resolution Proposing an Amendment Amend-ment to Section 10, of Article VII, of the Constitution Relating to Governor's Appointive Ap-pointive Power and the Filling of Vacancies Va-cancies in Certain Offices. (Superintendent (Superin-tendent of Public Instruction.) Be it resolved by the Legislature of the State of Utah, two-thirds of all the members elected t each house concurring concur-ring therein: SECTION 1. That it Is proposed to amend Section 10, of Article VII, of the Constitution of the State of Utah, as follows fol-lows : SECTION 10. The Governor shall nominate, nom-inate, and by and with the consent of the Senate, appoint all State and district officers offi-cers whose offices are established by this Constitution, or which may be created by law, and whose appointment or election is not otherwise provided for. If, during the recess of the Senate, a vacancy occur in any State or . district office, the Governor ahall appoint some fit person to discharge the duties thereof until the next meeting of the Senate, when he shall nominate some person to fill such office. If the office of justice of the supreme or district court. Secretary of State, State Auditor, State Treasurer, or Attorney-General Ije vacated by death, resignation or otherwise, it shall be the duty of the Governor to fill the same by appointment, and the appointee shall hold his office until his successor shall be lected and -qualified, as may be by law provided. SECTION 2. The Secretary of State is hereby directed to submit this proposed amendment to the electors of the Btate at the next general election in the manner provided by law. SECTION 3. The general control and supervision of the Public School System hall be vested in a State Board of Educa- ; tion, consisting of such persons as the Legislature may provide. SECTION 2. The Legislature may pro- ride by law that the stockholders in every corporation organised for banking purposes, pur-poses, or the holdera of any one or more of the classes of stock issued by any such corporation, in addition to the amount of capital stock subscribed and fully paid by them, shall be individually responsible for an additional amount not exceeding the amount of their stock in such corporation, or the amount of their stock of any parti- ceeding a determination by the Board of State Canvassers of the result of the election elec-tion designated in section 2 hereof.
