Irrigation lists rules The following rules and regulations are hereby adopted and promulgated by the Pleasant Grove Irrigation Ir-rigation Company (herein referred to as "Company") relating to the distribution of water by the Company and the use thereof by its stockholders or those designated by the stockholders. stock-holders. 1. No one shall change or alter the course of any Company ditch, or lateral nor shall they fill in, cover, move, concrete or otherwise tamper v;ith any ditch without me i written consent of the i Company's board of directors. di-rectors. 2. Pipes used shall be a minimum of fifteen (15) inches in diameter, of concrete, con-crete, galvanized steel, plastic, or other material acceptable to the Company's Com-pany's board of directors. 3. Cleaning and maintaining main-taining ditches by the Company shall be limited to the Company main ditches dit-ches only. All other ditches dit-ches are termed "private ditches" and are to be cleaned and maintained by the water users of that particular ditch. 4. The Company shall be held harmless from any and all claims, damage dam-age or liability which may arise with the use of such I private ditches, including flooding, runoff, failure to utilize scheduled turns, or for any other reason resulting in damage or loss to the person or property pro-perty of another. Each water user is responsible for the water during his scheduled turn. 5. Any person or persons per-sons who willfully perform per-form any act of vandalism van-dalism in any manner, whatsoever, in any part or portion of the Company Com-pany system will be pro- r : secuted to the full extent of the law. 6. No stockholder of the Company, or nonstockholder non-stockholder water user, shall interfere in any manner with the regulation regula-tion of the Company's dams or ditches, nor shall he divert to his use any water running in said ditches, dit-ches, until and unless he is entitled thereto by virtue vir-tue of his water turn. Violation constitutes a theft and the violator will be subject to prosecution. 7. No stockholder, or non-stockholder water user shall allow any ditch or lateral of the Company passing through the land of such stockholder or non-stockholder water user, or along a public street adjacent thereto to become clogged, filled or damaged by reason of any acts of such water ..users .or . his agents or employees, or as a result of the activities of his livestock. No person or persons shall dump or cause or permit to be dumped or discharged into in-to such ditch or lateral any refuse or other material whatsoever. 8. No person shall insert in-sert a headgate or place a dam in any ditch or lateral except during such time as he is entitled to the water or portion thereof while water is flowing or likely to flow therein. 9. Every stockholder, or non-stockholder water user shall be responsible for the water taken by him from the Company ditch during the entire time of his turn and shall not allow such water to flood upon the land or property of ancher or upon the public right-of-way. The violator is subject sub-ject to legal damages. 10. No stockholder, or non-stockholder water us er shall divert water from the Company ditch or lateral except at such point or points as may be allocated to him by the watermaster; and in no event shall the Company ditch or lateral be used as the head ditch for the general discharge of the water onto the land. 11. Each water user shall provide a suitable and sufficient headgate for diverting water from the Company's ditch or lateral at each of the points where he is entitled entitl-ed to take his water. Such headgate shall be in form and construction as is approved ap-proved by the water-master, water-master, both as to outlet on the Company ditch and the inlet to the diverting diver-ting head ditch of the water user. 12. No water user shall exchange turns with another so as to unreasonably interfere with the usual and ordinary or-dinary course or succession succes-sion of water turns and the use of the water along the stream, lateral or ditch without the approval ap-proval of the water-master. water-master. 13. Each stockholder, or non-stockholder water user shall cooperate with the watermaster for the orderly, equitable and efficient distribution of the water. 14. Every water user shall promptly report to the watermaster any damage to any part of the Company's system that might come to the attention atten-tion of such water user, or any infraction of the rules and regulations of the Company which might result in any damage or injury to the Company. These rules and regulations regula-tions were approved by the board of directors on March 31, 1988, and took effect immediately. Published in the Pleasant Grove Review May 4, 1988. |
