PUBLIC NOTICE IS HEREBY GIVEN that on the 16th day of July, 1985, the City Council of Pleasant Grove City, Utah County, Utah, adopted a resolution declaring its intention to create a special improvement district to be known as Pleasant Grove City, Utah, Special Improvement District No. 85-1 (the "District"). It is the intention of the City Council to make certain street and sewer im-proverrients im-proverrients within the proposed District and to J.evy special assessments as provided in the Utah Municipal Improvement Im-provement District Act, Chapter 16, Title 10, Utah Code Annotated, 1953 as amended (the "Act"), on the real estate lying within the District for the benefit of which such assessments are to be expended in the making of such improvements. Description of District The boundaries of the proposed District shall be conterminous with the existing Pleasant Grove City boundaries as of the date of this notice (see map attached at-tached hereto) and shal consist of all tracts and parcels of land abutting 1400 East Street from 200 South Street to 250 North Street, and all tracts and parcels of land within the boundaries boun-daries of Pleasant Grove City upon which are situated houses, buildings or properties used for human occupancy, oc-cupancy, employment, recreation or other purposes, and which have a property line or lines within 200 feet of a city sewer line. To the best of the city's knowledge, the tracts and parcels of land that meet the aforementioned aforemen-tioned designation and will therefore be subject sub-ject to special assessment within the District are those listed in Schedule 1 attached hereto and by reference made a part hereof. All improvements are on streets within the boundaries of Pleasant Grove City. Intended improvements The improvements to be constructed within said Special Improvement Im-provement District No. 85-1 in general include the following: Area 1 - 1400 East Street The existing 1400 East Street from 200 South Street to 250 North Street will be replaced with a new asphalt road surface and rolled curb. The work will include excavating and replacing the existing road and constructing a rolled curb on the east side of the road. Area 2 City Sewer Lines Owners of all houses, buildings or properties used for human occupancy, oc-cupancy, employment, recreation or other purposes, with property lines within 200 feet of a city sewer line must connect to the sewer and pay a connection fee. For connections to city sewer lines installed in-stalled by the City since 1970, the fee includes lateral costs, hookup fees, and cost of sewer per linear front footage. For connections to lines installed prior to 1971, the fee includes only a hookup fee. The connection con-nection fee is based on a new City ordinance passed by the City Council on March 19, 1985. The connection fee payment may be extended ex-tended over a longer period of time through the Special Improvement Im-provement District. The connection must be made with respect to City sewer lines now existing and a new main sewer line to be constructed on 600 West Street from 1800 North Street to 2600 North Street. Costs on constructing con-structing this new main sewer line will be borne by the City, in part from a federal grant, and owners connecting to this line will be required to pay only the connection fee described above for connections to lines installed since 1970. Location of said sewer improvements -1300 West Street from the north property line of Garden Village Subdivision to 1100 North Street. -1100 North Street from 1300 West Street to 1520 West Street except lots in the Firwood Subdivision. -600 West Street from 1100 North Street to 2600 North Street except the Pleasant Green Acres and Noble Estates Subdivisions. -1800 North Street from 600 West Street to 900 West Street except the Cascade Meadows Subdivision. Estimated cost Z'of improvements r The total cost of improvements in said proposed District as estimated by the City Engineer is $371,799, of which the City wil pay $200,250, leaving a remainder of $171,549, which shall be paid by a special assessment tax to be levied against the property abutting upon the streets to be improved im-proved or upon property which may be affected or specifically benefited by such improvements. The property owners' portion of the total estimated cost of the improvements may be financed during the construction period by the use of interim warrants. The interest on said warrants will be assessed to the property owners. It is proposed that assessments on property in the District to pay the portion of the costqf improvements to be borne by the owners thereof will be levied according to the benefits to be derived by the property from the improvements. The estimated cost to be assessed against the affected properties within the District shall be as follows: Area 1 -1400 East Street 1. The assessment for the cost of the street improvements within area 1 are estimated to be $14.68 per front foot. Area 2 -city sewer lines Each affected property within area 2 requiring a connection to a sewer line installed before 1971 will be assessed a sewer connection fee esetimated to be $1,000 per dwelling unit. Each affected property within Area 2 requiring a connection to a sewer line installed since 1970 will be assessed a sewer connection fee comprised com-prised of the aggregate of the , following "' estimated charges; 1. $14 per front foot up to a maximum of 150 feet; 2. $400 for each lateral sewer line from the property line to the main sewer line in the street (each property owner must pay on his own, not as a part of the assessments described herein, the cost of the sewer line from the property line to the dwelling unit) ; and 3. $1,000 per dwelling unit. Assessments and levy of taxes It is the intention of the City Council of Pleasant Grove City, Utah, to levy 1 assessments as provided by the laws of ; Utah on all benefited parcels and lots of real property within the District. The purpose ol the assessment - and I levy is to pay those costs of the subjeel ' improvements which f ,the city will not assume ' and pay. The assessments maj i be paid by propertj owners in ten 10 annual installments with interest on the unpaid balance at a v rate or rates fixed by the City, or the whole or any part of. the assessment may be paid without interest within fifteen (15) days after the ordinance levying the assessment becomes effective. The assessments shall be levied according to the benefits to' be derived by each property within the District. Other payment provisions and enforcement remedies -shall be in accordance with the Act. A map of the proposed District, copies of plans, profiles and specifications of the proposed improvements and other related information in-formation are on file in the office of the City Engineer who will make such information available to all interested in-terested persons. Time for filing protests Any person who is the owner of record of property to be assessed in the Districfdescribed in this Notice of Intention In-tention shall have the right to file in writing a protest against- the creation of the District of to make any other objections relating thereto. Protests shall describe or otherwise identify the property 'owned of record by the person or persons mailing the protest. Protests shaft be filed with the City Recorder of Pleasant Grove City, Utah, on or before 3 p.m. on the 3rd day of September, 1985. Thereafter at 7:00 p.m. on the 3rd day of September, 1985,. the City Council will meet in public meeting at the City Council Chambers to consider all protests to be filed and hear all objections relating to the proposed District. Section 10-16-7(3) of the Act provides that Xhe District will not be created if the necessary number of protests as provider therein have been filed on or before the' time specified in this Notice for the filing of protests.
