The plaintiff is samg for $10,767 damages, dam-ages, alleged to be due by virtue or property and personal damages sustained sus-tained by virtue or an accident al-lo-o'i tr, have been occasioned by the defendant about four years ago. iiie complaint alllrms that on the 11th day of June, 1905, while the plaintiff plain-tiff was driving a horse attached to a hay rake on the public highway, near Farr West, immediately northwest ot Ogden. the defendant came up from tho rear with an automobile and that In the blowing of the whistle or tno machine bo frightened the animal in the hands of the boy that it became frightened and ran away, upsetting the hay rake and throwing the boy Into a wire fence, and dragging him for a long dlHtanco, badly lacerating his body and almost killing him. The complaint further allcgos that tho hay ralce was practically demolished, the horee damaged, the harness torn, besides be-sides other damage that was done. This was all occasioned, according to the allegations of the complaint, through and by virtue of lho negligence negli-gence of the defendant. It Is also said in the complaint that because of the accident, medical services ser-vices had to bo procured which cost money, something like $150, that the damage to the horso and harness ana hay rake amounted to considerable, and that also the mother of the boy, Mrs. Rebecca Wardle, was deprived ot the service of her son for a time, which would amount to a loss to her of about $600, withal amounting to about $767. It is further claimed that the boy has been damaged In tho sum or ten thousand dollars because of the serious seri-ous injuries sustained by him.
