Show PART SETTLEMENT IN MERCHANTS BANK CASE SALT LAKE, Juno 5. Authorization Authoriza-tion was given yesterday by Judge W. H. Bramel.of the Third district court to Stephen I-I. Lynch, receiver for the Merchants' bank, to accept the $100,-000 $100,-000 offered In settlement by five of the defendants in the suit brought by the receiver against twenty-nine former dl-Tectors dl-Tectors of tho bank to recover $800,-000 $800,-000 alleged to havo been lost through mismanagement. Hearing will be had before Judge Bramcl this afternoon at l-:30 o'clock on the receiver's second petition to accept ac-cept $110,000 from nine other defendants. defen-dants. Trial of tho case against the defendants not excluded by such settlements set-tlements Is scheduled to begin Monday beforo Judge P. C. Evans. In the course of tho hearing on tho petition yesterday morning, a statement state-ment waa mado by Attorney Frank E. Holman of counsel for the receiver, In which appreciation waa expressed for tho course taken by the former directors di-rectors in making settlemont. In that it constitutes ovldcnco of a disposition disposi-tion to freo tho money for tho bonoflt of tho bank's doposltors rather than to involve it in litigation. nn |
