Show RICKEUT BEFORE THE COURT ON SERIOUS CHARGE T. Rickert, accused of removing a lock from the door of a residence on Grant avenue, near Twenty-fourth street, was given a preliminary hearing hear-ing this morning in tho municipal court on a charge of attempted burglary bur-glary in the second degree. After hearing the evidence, Judge Reeder look the case under advisemut. The witnesses for the prosecution, which was conducted by County Attorney At-torney J. E. Evans, were G. C. Street-er Street-er aud Patrolman. R. PL Wootten. According Co the evidence given by Streeper. he found Rickert under an old cot in a room at his home, on the night of October 28, and that a lock which had been on the front door, had been dropped by the defendant while he was being taken from the hodse to the police patrol. The defendant de-fendant claimed that he had not touched the lock, but had found the door open and, as on other nights, had just gone upstairs to sleep, lie also said that he had thrown his tobacco tobac-co can on to the stairway. Patrolman Wootten testified or the arrest and stated that he saw tho tobacco to-bacco can on the stairway also saw the lock after Mr. Streeter picked it up. Rickert was defended by Attorney Caleb Marriott, who endeavored in his argument to prove that his client cli-ent had merely gone Into the house to rest and had not intended or done anything which would tend to prove that a crime had been committed. no |
