Acting Governor Govern-or David Mattson declined yesterday to honor a requisition from tho governor gov-ernor of Wyoming for Joseph Leavltt, a well-known Salt Lake resident and at present proprietor of the Success market, against whom, In Rock Springs, Wyo., thero hangs a charge of mayhem preferred by ono Edward AneBl, who claims that Leavitt well-nigh well-nigh bit his finger off. Tho charge is indignantly resonted by Mr. Leavitt, who says that as the climax of potty annoyances and threats, induced by professional jealousy, jeal-ousy, Aneal attacked him In a saloon at Rock Springs; that ho responded merely with his fists, in self-defonso, and that Anesi's finger was Injured by contact with tho Salt Lake man's scarfpin when Anesi aimed a fist for his pbin. In tho absonco of Governor William Spry, the requisition from Governor John B. Kendrlck of Wyoming was presonted to Acting Govornor Matt-son Matt-son yesterday by Doputy Sheriff Mike J. Danowslcl of Sweetwater county. This Wyoming official lived In tho hope that he would take Leavitt back with him to Rock Springs, but tho acting act-ing govornor declined to act upon tho requisition until County Attorney Frank A. Johnson of Sweetwater couu-ty couu-ty appears to make further reprcsenta-: reprcsenta-: tions In the case. Tho complaint, a copy of wbloh ac companied tho Wyoming governors communication, set forth that tho alleged al-leged mayhem occurred In the Manila saloon at Rock Springs on the evening of November 1, 1915. Leavitt 1b charged with biting and maiming one of Anesi's little flngerB. Mr. Leavitt admits that he was In Rock Springs at the tlmo and h:id an altercation with Anesi, which ho Bnys tho latter provoked. He tuld tho acting act-ing governor that he was traveling for a whisky houso at tho tlmo and that Anesi was, In a mannor of speaking, a competitor. "Anosi was jealous of mo, said Leavitt. "For sbc months he had threatened me. Ho owed my house a little bill. I insisted on a settlement, and that Increased his feeling against me. Many times he threatened mo; threatened to drive mo out of Rock Springs. I had warned him that if ho had an accusation to make against me he could complain to the authorities I had told tho mayor of Rock Springs of the man's threats. Finally, on the night in question, Anesi threatoned mo furthor, and then Btruck mo. I do-fended do-fended myself, hitting him with .my fists only. He struck at mo several times and in one blow caught, his finger fin-ger and tore it on my scarlpln. Ho knows this, and this chargo Is moroly to get mo back in Wyoming and persecute per-secute mo further." Mr. Leavitt was at one time, years ago, a member of tho Salt Lake police force- For many years he traveled through the surrounding territory for a Salt Lake liquor houso. More recently re-cently he has boon in the market business. |
