Howell announced this afternoon that he had granted tho writ of habeas corpus m the caso of Ogden City against Hoken Olsen and that the prisoner should be discharged. dis-charged. This action necessitated tho dismissal of throe other appeal cases against Olsen, who was tried in the municipal court for violating the liquor lawB of the stato. History of the caso in question 1b that Olsen was tried by Attorney Wade Johnson as Judge pro tem of the municipal court He was found guilty and was sentenced to a flno or Imprisonment An appeal was taken and when the case was set for trial In the district court, the appeal was dismissed. Then tho attorneys for Olsen sued out a writ of habeas corpus cor-pus on the grounds that the district court did not have jurisdiction, as a Judge pro tem of the municipal court could not havo jurisdiction of the case under the statutes of tho state. oo |
