Show oo SUIT IS OVER PURCHASE OF LAND To compel tho Ogden Medicinal Springs company to carry out an agreement for the purchase of certain lands situated at the mouth of Ogden Og-den canyon on which was formerly operated the Ogden Canyon sanitarium, sanitari-um, the Utah Light & Railway company com-pany commenced an action in tho district court yesterday afternoon. The complaint alleges that on August 7, 1002. the Ogden Investment company leased the lands In question 0l Fred J. Klesel. the Snake River Valley Farm company, and the Utah Light & Railway company, each own Ing a third Interest with an option to buy the property for $12,000; that the defendant company became the successor to the Ogden Investment company and took over the lease and option to purchase and that, at a recent re-cent date, proffered to purchase. An abstract of title was made out the complaint avers, and arrange ments made to turn the property over at the agreed price, but the defendants defend-ants failed to close the deal The plaintiff company claims that It Is entitled to one third of the agreed purchase of J12.000 and $1,000 damages and costs, making In all $5, When the abstract of title was made out some time ago. it was sta ted by the parties Interested, that the deal bad been closed and the real estate es-tate turned hut to the defendant company, com-pany, but, although the company has not filed an answer to the complaint, t is understood that the deal has been held in abeyance because of a disagreement dis-agreement respecting a right of way over the property for an electric transmission line owned by the plaintiff. plain-tiff. oo |
