Show GEORGE KELLY DENIES HAVING manipulated UTAHNA STOCK ogden august 10 1905 editor standard not being desirous of having my personal affairs aired in the newspapers nor of giving out hot air interviews I 1 have heretofore retrained from doing so but I 1 feel that some of the articles published in regard to the utahna theater company place me in a false light I 1 take exception to that portion of the reported interview with mr W R gourley published about august ath taken from the salt lake herald regarding the transaction of the ertman stock which reflects upon me personally and I 1 brand it as absolutely false the published interview was as follows mr ertmann Ert mans stock which with mines constitutes over one third of the total lie was obtained by mr kelly a few months ago to be held in trust tor one year mr ertman believed that there was a movement on foot to dispose of the theater to a denver syndicate mr kelly however included mr erb mans shares in the block of stock sold to and button lie the facts are that mr butmans Brt mans stock was included in a majority pool of the stock of the utahna theaters and parks to be voted or sold by me as a majority of the pool should direct when the contract for the sale was made we understood that it was satisfactory to mr ertman and mr gourley both mr runyon our president telephoned to salt lake and obtained that reply from mr gourley before the contract was signed although gourley was not a member of the pool he and all the salt lake stockholders were offered the privilege of putting up their share of the stock sold later when the sale was to be finally closed mr ertman objected to the sal of his stock according to our agreement of sale although a member of the pool and was bound by it tor the reason that he wanted spot cash and our contract was for part cash and the balance at a later date he offered no objection to the price and offered to accept the same in cash this we declined to do and sold a majority of the stock and left his stock out of the sale and it never was sold or contracted to be sold to sutton or scort by mo or any one else mr Gour leys interview to the contrary notwithstanding artman offered the stock to me once for cash but I 1 declined to take it at the time afterward I 1 offered him the cash for the stock and he declined to take it then after all this on the morning of july S before I 1 was out of bed my telephone called me and upon getting to it I 1 found mr ertman at the salt lake end of the phone asking me to buy his stock 1 I asked him it he would do certain other things if I 1 would purchase his stock at he price named by him he agreed he would do so I 1 then and there purchased his stock and agreed to pay cash borit and be agreed to sell and did sell it to mo asking me to come to his home to deliver to him his money which I 1 agreed to do as soon as I 1 could get the made up I 1 went to my attorney and had the papers made up and went to salt lake city on the afternoon train and went to the residence of mr ertman and offered him hla money but he declined to take it although he did not then cpr npr haa he ever since denied to me our contract over the tele phone 1 I simply told him the stock was mine for I 1 purchased it and it he did not think so he could proceed against me in the courts 1 I followed the advice of my attorney in the whole deal and can prove the sale to be absolute to the satisfaction of any court and any man who states that it was other than a straightforward deal on my part states that which is absolutely false signed GEORGE butte mont aug lo 10 from western montana detate forest fires are raging near the idaho line and extensive damage la threatened |
