Show NEW YORK. Feb. IT Frank J. Gardner's trial on charges of attempting attempt-ing to brlbo Otto G Foelkcr of Brook-ljn, Brook-ljn, while both were members of the state senate In 190S, began to cover old ground this nflernoon with the lull lu-ll oductlon of testimony brought out by tho graft committee. Foelkcr was again under fire by the defense. When he left the stand the state began calling call-ing wltnossos who testified to Gardner's Gard-ner's alleged attempt at bribery. The last examined was Robert II. Elder, assistant district attorney of Kings county (Brooklyn) .whose original orig-inal testimony before the graft committee com-mittee resulted In Gardner's Indict-menu Indict-menu Mest'ngs at Delmonlco. Elder told of Gardner's coming to his office in Mnrch, 1910, at his request re-quest and speaking of alleged meetings meet-ings at Delmoulco's of men Interested In racing who contributed to a fund to defeat the pending legislation. ,"Ho mentioned tho names of tho men." Elder testified. "Including James R. Kecno, Geno Wood, Harry Payne Whitney, Charles H. Hyde (tho city chamberlain) and Mr. Parsons." Elder repeated his Merrltt testimony testi-mony about Gardner going to Albany with Hyde and distributing tho "boodle "boo-dle rund ' Ho reiterated his testimony testi-mony that several newspaper men at Albany received money. Under Cross-Examination. Max Steuer, for tho dofense, on cross-examining the witness, asked him If ho bore Hyde hostility. Elder replied that he did not. He added- that at the time of the convetsatlon he had with Gardner, there wore indictments indict-ments in the district attorney's office against Hyde's brother-in-law, Engl-mann. Engl-mann. In response to other questioning. Elder said he had made n report to tho governor, but had not referred the mattor to the prosecuting attorneys attor-neys of either Albany or 'New York counties. |
