Show LIQUOR; LAW; EFFECTIVE' " MAY 10 Salt Lake, April 22. 'According to tho expressed opinions or Attorney General Albert R. Barnes, County At-tofnov At-tofnov I. a Wllley and City Attorney Attor-ney H. J DInniny, tho new liquor law, onacted by the recent legislature, which has given rise to so much comment com-ment nllke in the matters of Its general gen-eral effect, the exact date upon which it becomes of force and its constitutionality, constitu-tionality, will take effect Wednesday, May 10, when all previous laws passed in relation to the manufacture and sale of Intoxicating liquors will stand repented. TheBe officials, when separately" Interviewed In-terviewed yesterday, said that under the provisions of section 25,- article 6 of the constitution, all laws enacted shall be published and take effect sixty six-ty days after the adjournment of the legislature. They set forth that tho legislature began Its session January 9, 1911, that under section Ifi, article G of the constitution, Its legislative powers ceased March 10, 1911, and that consequently, there was little room left for diBpute as to the new law going Into effect May io, of this year. 'By constitutional provision,"' said Attorney General Barnes, 'the liquor measure enacted by the last legislt-ture legislt-ture will on May 10 next replace and repoal every other law relating to the manufacture of intoxicating liquors li-quors and the granting of licenses for the sale thereof. "This means that on that date all previous laws on 'tho liquor traffic will become null and void, the new measure with its many provisions will become at once effective, and ordinances ordin-ances will necessarily be enacted by the governing bodies of the various municipalities and townships in accordance ac-cordance with the provisions of the now state statute. What Is the Effect? "So far as the general effect of tho new law Is concerned, especially In direct relation to Salt Lake and the ordnances of this city, I am no more prepared than anyone else to say what It is golng'to be. Our present ordinance on liquor traffic will stand repealed on May 10, when. In ray opinion, new laws in proper harmony with the state-law on the matter will have to be pnssod. .T "Considerable has been said of late both for and against tho now measure, meas-ure, and It has come te my hearing that flaws and unconstitutionalities have been discovered in different sections sec-tions und tho wliole thereof, but as to the truth of this I am not in a position to declare. "In my opinion," ho said, "there Is no question but what tho new law takes effect May 10, next On that date according to the constitution, the now liquor statute so-called, which Is chapter lOfi of the laws of 1911. will become In full effect and operative opera-tive "It is perfectly plain to mo,' he continued, con-tinued, "that tho object of this law was not in tho interests of good government gov-ernment or fair and honest dealing, but with a view, as were most of the other acts of tho recent legislature, to do all possible damage to tho rights of the citizens of this cltv. "By section 69 of this chapter 106 all laws with relation to Intoxicating liquors are repealed, which repeal takes effect, In my judgment, on the Baid 10th day of May. at which time this new chapter goes into offecL After that time, under the law. the cltv council will not have power to grant any moro Honor licenses except by order of tho district court, that power having been vested In tho district court. "According to this chapter 10C of the laws of 1911, and section 3 thereof, city councils of cities of the first and second Slass can only grant liquor licenses li-censes by order of tho dlBtrict cpurt, while city councils of cities of the third class and boards of trustees In incorporated towns, hundrods of which are scattered all over this state In tho outsido counties, have the power to grant such licenses, and under certain cer-tain conditions county commissioners havo the Hko power, so that whllo u little city of the third class having) a population not to exceed five thousand, and tho board of trustees of an Incorporated In-corporated town having a population ot three hundred, may Bay who is competent and proper to havo Honor licenses, while .a. groat city Hko Salt Lake, with a population of about ono hundred thousand, Is prevented from exercising any such power or right "Consequentlv. the state having refused re-fused to permit the city council or tho governing legislative body of this city to decide who among "its citizens citi-zens shall bo entitled to a liquor license, nnd has placed that right upon up-on a state officer. I recommended that tho council repeal all ordinances that have to do with the sale of intoxicating intoxicat-ing liquors, to enact a new ordinance fixing the amount of the licenses in accordanco with section 7 of this no' law. and fixing the limits within which liquor may be sold as provided In section sec-tion C" |
