Show COUNTER mi I BARRETT CASE In the divorce caso of Alfred Ber-rott Ber-rott against Sarah Jane Bcrrett the defendant has filed an answer and counter-claim, in which she avers that the plaintiff, since the marriage of the parties has been cruel and abusive, abu-sive, at times using vile language toward to-ward her. .Mrs. Berrett reiterates the fact that shd married Mr. Berrett July 20, 187C, at North Ogden and that since that time they have lived together as husband hus-band and wife. Sho slates further that on September 15, 1909, she was driven from her home by the plaintiff and scandalously abused by him. Sho also states that In the year 1898, herself her-self nnd husband deeded to their children, chil-dren, four being Mr. Borrett's chil-dion chil-dion iind two her own, ull of their community property, llio understanding understand-ing being that they should furnish them an aunultv during life of $77.50, ?37.50 to be paid by hits children and 1 10 bv her children. The" names of the children are .Hamlet .Ham-let and Martin Berrett, Victoria, Marshall, Mar-shall, Mary Ann Chord, Lona Ham-bly Ham-bly and Maud Storey, and Mrs. Bcrrett Bcr-rett asks that thoy bo made parties to the action and bo compollcd to pay tho annuity. Tho court yesterday aftornoon issued is-sued an order making tho persons above named parties to the suit. The cross-complaint urges that the parties be granted a dlvorco and that tho children be compelled to keep their promises iegarding tho annuity agreed upon in 189S. Mrs. Berrett states that sho ia fi2 years old and has an Income of only $0 a year. Sho wants the costs of suit paid by Mr. Berrett. |
