Show 'PROTEST IUM OPfllKpilE A commltteo led by R H. Trulllnr;-er, Trulllnr;-er, representing properly owners on Lincoln avenue, between Ogden river and Second street, appeared before the city council Inst night end protested pro-tested against the opening of the avenue in that district, and asking that the matter of advertising for bids for the opening of the same be deferred de-ferred until a conference could bo had with all of the property owners there. The members of the committee stated that fullj 90 per cent of tho property owners on Lincoln avenue in the district whore It is proposed to be opened, were opposed to the opening open-ing If they had to dedicate their property and also pay a cash tax. They are willing to dedicate the property prop-erty but refuse to be taxed In addition. addi-tion. II was also slated by Mr Trul-Hnger Trul-Hnger that the parties who signed the petition for the opening of the avenue ave-nue were misinformed In relation to the terms upon which the opening would be made City Attorney De Vine stated that the council had gained Jurisdiction and that he could see no legal way that they could recede from their ac tion. He explainod tnat the notice of Intention of opening the avonuo be tween tho river and Second street had beon duly published and that all parties par-ties Interested In tno matter had been gfvon an opportunity to appear and file their protests. They had failed to do so and the engineer reported Jurisdiction Juris-diction in the promises. After a brief discussion on the matter mat-ter by members of the council it was determined that the property owners of the district bo invited to meet the city attorney, city cnglneor and tho street committee at the council chamber cham-ber Friday afternoon at 2 o'clock. Saloon Loses License. The Norman and Borrel company, conducting a saloon on Twenty-fifth street, between Lincoln and Wall avenues represented to the council that they had been deprived of a 11-censo 11-censo to continue their business, bo-cause bo-cause a check which they had sent to the council had been returned from the bank marked "no funds." Mr. Borrel stated that when tho check was sent to tho council the money was In the bank, but that the treasurer failed. to present It for a number of days after, tho money having hav-ing been withdrawn in the interim. He statod, however, thnt he had tho money to pay tno llcenso now and he desired that tho council roconslder Us action of rescinding tho action granting tho license. Must Go Before District Court. The city attorney advised the city fathers thnt they hud lost their licensing li-censing po.wer and that it would be folly for them to undertake to reconsider recon-sider the nctlon of rescinding. He also sUitcd that the parties would now havo to apply to the district court for a license and that they would havo to comply with the provisions of the new liquor law In so doing. The council took no action. A communication 'from tho mayor urged that action be taken on a petition peti-tion "of property owners for Ihc disposition dis-position of flood waters of Wall avenue, ave-nue, between Twenty-first and Twenty-second streets, because the petition was meritorious. The mayor's suggestion sug-gestion was adopted and the matter vas referred to the street committee and the city engineer. The recommendation of the waterworks water-works committee that additional water wa-ter mains be laid in tho vicinity of Plngree, Endlon and Chester avenues, ave-nues, and that a hydrant be placed at Plngree and Chester, was adopted. Must Pay For Gravel. Upon the recommendation of the committee on public buildings and grounds, it was determined that the Moran Construction company be required re-quired to "pay a reasonable sum" for the gravel they have and are taking from the streets of tho city. It was also decided by the council that the fences in Franklin Place Addition Ad-dition be properly adjusted. This was recomended by tho street committee. The same action was taken regarding regard-ing the fences on the alleyway from Cook street to Second. The auditor was Instructed to draw a warrant to pay Interest on waterworks water-works bonds In the sum of $10,000 and also for claims against the waterworks water-works department In the sum of $2,-910.50. $2,-910.50. Tho purchasing agent was authorized author-ized to purchase 5000 feet of red pine for street repairing purposes, to be used by tho street supervisor. The petition of property owners for tho extension of water mains on Hudson Hud-son avenue and Thirty-second street, was referred to tho waterworks committee. com-mittee. Concrete Brldgo on Grant Avenue. Tho matter of bulldlug a concrote bridge over Mill creek on Grant avo-nue, avo-nue, was referred to the street committee. com-mittee. The matter was brought to the attention of the council by street supervisor Jones. Interest on bonds In the sum of 52007 was ordered payed The matter of recelvlTig bids for bituminous paving on Twenty-fourth and Twenty-fifth streets, east of Washington avenue, was referred to the city onglnecr and the attornoy. The potltlcn of Father Cushnahan regarding tho proper drainage of an open ditch near the Sacred Heart academy was granted. Judgec of Election.
