Show BERTHA CARR RISE'S FOR'1 DIVORCE s ; Robert J. Carr has been cited to appear .before Judge Howoll, May 26, and show cause, it ho has any, why ho should not bo required to pay temporary tempor-ary alimony, attorney fees and costa of suit In dlvorco proceedings. Mrs. Bortha Carr this morning pe-tltloncd pe-tltloncd the district court to end tho marriage relationship between herself her-self and hus;band, Robert J. Carr, on the grounds that ho has been and Ik now cruel and inhuman toward her. Mrs. Carr says that at dlverao times during the past ear the defendant de-fendant has been cruel 'and abusive, using vile and vulgar names and becoming be-coming so obnoxious to her 'that ho Is Intolerable. ' The plaintiff states that at the Utah Hot Springs, April 7, of this year, tho defendnnt called her bad names In the presence or other people and that In October, 1009, he grabbed her about tho throat and choked her, and so violently assaulted her that her brother-in-law had to Interfere and take her husband away from her. She says further that Mr. Carr has an ungovernable temper and that for some time past he nas been quariel-some. quariel-some. The petition relates that the parties were married in Ogden November 14, 1000, nnd that the,) have a boy three years old. Ballard Divorce. rIn tho case of Mattle L. Ballard, Judge Howell this morning gi anted the plaintiff a divorce and awarded to her the custody of the minor child. Mrs Ballard enjoined the Southern Pacific company with the defendant in , the action and requested that the company be enjoined from paying Mr. Ballard his salary until a settlement of the case could be had In the meantime, however, an agreement had 'been reached between the parties as to tho distribution of the community interests and the railway company waa released from the injunction. In July last year the defendant deserted de-serted the plaintiff nnd minor child and has since lived away from them and failed to provide for them. The court grants the dlvorco, awards the care and custody of the minor child lo'tho plaintiff, nllows costs of suit and attorney foes. ihe prpperty rights wore adjusted by mutual consent. |
