Show UU FILE ANSWER IN DACE HORSE CASE In the case of L. R. Ecclcs agalnBt W S. Hamilton and Paul Morris, the defendants havo filed an answer in which they alleged the complaint is not true and In a counter-claim they declare that the plaintiff is indebted to them for the expense of feeding and training hordes and for money loanod the plaintiff at El Paso, Texas. Tho counter claim avers that the plqlntlff bargained with the defendant Morris to train the horse "Glmmoir and put him In condition for racing. It also says that the borse is worth 51,000 and that "Tube Rose" is worth $500 as a race horse, but that they are not worth anything unless they are In condition for racing and that to put them In condition requires from six months to one year's time In the hands of expert horsemen. The counter-claim sets forth that tbe animals never did belong to plain tiff and that he never was entitled to their possession: but that If the court should decide that the plaintiff Is entitled en-titled to the animals the defendants should be paid for training them, and for the expense of keeping them for a number of months past. Tho defendants further allege that the plaintiff employed them to train the race horses "Gimmell," "Tube Rose," "Hoopla" and "Inauguration," for which they were to be paid at least $2.50 a day and all the expenses incident to the training, and that the defendants should bo entitled to all the winnings of the ponies, over and above the expense of training. The defendants say that Instead of the horses winning they are losers, "Gimmell" "Gim-mell" losing $769, "Hoopla" $GS0, "Inauguration'' "In-auguration'' $190 and that "Tube Rose" also lost. The defendants also claim that In August of last year at El Paso, Texas, they loaned the plaintiff about $700 and that tho amount has not been paid back, except that $240 was paid them at El Paso. The allegations of tho counter-claim are that there Is a balance bal-ance of $3,231.50 duo the defendants. They ak judgment for this amount and for the possession of "Gimmell" nnd "Tube Rose." |
