Nairne. 4 44$,4444444QOQ$ The foregoing is the announcement announce-ment by postal card from a member of the firm of attorneys for the plaintiffs plain-tiffs in the case of Perry, Seoit and two others vs. the Delta Land & Water Company, which was tried before Judge Willis in the Superior Court of Los Angeles county, California, Cali-fornia, this summer: Several witnesses wit-nesses from Beaver county were summoned to the southern metropolis metropo-lis and testified in the case. Upon further inquiry '.re hae learned that while the findings have not been handed down by the Judge and probably will not be so recorded for several weeks owing to the manner man-ner of procedure in the courts of California, he has indicated verbally that his decision in the matter will be in favor of the plaintiffs. The case will next go to the Court of Appeals, we are informed by the defendant corporation, and there is little doubt that whoever wins will eventually secure a decision .from the highest court to which the case can go upon appeal. This will doubtless doubt-less require several years' time to procure the final decision of the courts. This case is not one brought by . the large number ot settlers who left the project last year. Their eases have been ruled out of the California Cal-ifornia jurisdiction and mus! -be 'Drought in Utah and tried here if they decide to take further action, as they declare thoy intend to do. We are informed that the decision deci-sion just given out in Los Angeles will have "absolutely no effect upon the status of the project and the new work undertaken to place the plant of the Heaver County Irrigation Company in the best condition possilde pos-silde for next season. The work now being done is of a most substantial character and is well worth the trip to the scene of action to see the heavy cement and concrete structure struc-ture being erected at the new intake of lite canal. . |
