Answer Rd Dmbnr EnltrpritM Murder Suspects Lawyer Files Motion to Dismiss Charges Special to The Tribune More than 10 preCOALVILLE trial motions have been filed by Ken Brown, defense attorney for accused murderer Preston Mitchell, including requests to dismiss the murder and aggravated burglary charges or reduce the murder charge. Mr. Mitchell is being held without bail in the Summit County Jail in connection with the August 1984 shooting death of airline pilot Fred Duncan. A trial is scheduled Jan. 21. Mr. Duncan was killed Aug. 4, 1984, at the Park City home of Brian Oliver by a single gunshot wound to the head. Mr. Mitchell was indicted for the murder by a Summit County grand jury May 6, 1985. He remained a fugitive until Oct. 10, when he was apprehended by FBI agents in Springfield, Mo. Attorneys for Mr. Mitchell also feel that because of pretrial publicity they should be granted a change of venue in the case. In addition, they would like various statements made by Preston Mitchell to be suppressed. For nearly 14 months Mr. Mitchell eluded police and FBI agents. Mr. Brown has also filed a motion to exclude any evidence of flight by Mr. Mitchell. Patty Tyrell, who was Fred Duncans fiance, testified in the preliminary hearing that she was with Mr. Duncan at the time of the murder. Ms. Tyrell recounted she was in Brian Olivers home watching television with Mr. Duncan when someone burst into the room and shot him. In November, Ms. Tyrell testified that in her opinion that person was Preston Mitchell. Mr. Brown is asking to suppress or disqualify the testimony of Ms. Tyrell. Other motions involve suppressing evidence obtained from telephone conversations and a desire by the defendant to have a separate jury hear his trial, and a separate jury, should e he be convicted of murder, to sentence him. first-degre- Six Years to Life Ogden Killer Sentenced to Prison An Ogden woman OGDEN (AP) has been sentenced to six years to life in prison after pleading guilty to -degree murder in the Nov. 20 shooting death of the director of the Senior Companion Program for Wesecond- ber County. Kittie Elizabeth Eakes, 27, was sentenced Monday by 2nd District Judge John F. Wahlquist. One year of the sentence in Utah State Prison is for use of a firearm in the crime. Eakes was sentenced on the spot after she waived her right to a presentence report. She pleaded guilty to shooting Sharol A. Wetzel of Ogden in the head while the two of them were sitting in Wetzels parked car near Lorin Farr Park. She earlier had pleaded innocent by reason of insanity. "I definitely wish this never happened, Eakes told Wahlquist. After this today, youll never see me in court again. Her attorney, Bernard Allen, told the court that Eakes said Wetzel owed her money. The attorney said Eakes and Wetzel were sitting in the car discussing the debt when Wetzel said she couldn't repay it because of a recent divorce. He said Eakes complained that she has been paying for others her whole life, then took a gun from her purse and fired one shot that struck Wetzel in the head. Deputy Weber County Attorney William Daines said the prosecution in all likelihood believed that Eakes was acting as an agent for someone else in the murder, but couldn't prove it. He didn't elaborate. Eakes changed her plea to guilty without negotiation from his office, Daines said. Allen said Eakes wanted to change her plea, even though the Public Defender's Association believed there might be merit in the insanity defense after receiving reports from analysts. court-appointe- d Bandit With Knife Robs Bank Special to The Tribune A robber who threatened three tellers with a long hunting knife took an undetermined amount of money from First Security Bank's Cottonwood-HolladaOffice, 4711 S. Highland Drive, Tuesday at 2 He said as the suspect entered the bank's north door, forced the tellers to hand him the money and then walked out the south door and removed the mask. He was last seen walking past a p.m. Agent Richards said. The suspect is described as about 25 years old, with light brown hair and mustache and apparently was starting to grow a beard. S20 .Million Sought Miners Widow Sues UP&L The second widow of a Wilberg Mine disaster victim has filed suit in 3rd District Court, seeking $20 million in damages from Utah Power and Light Co., the owner of the Em- ery County coal mine. Geraldine M. Nevitt, Wellington, Carbon County, alleges that because of negligence on the part of UP&L, her husband. Joel, was trapped in the mine by a fire on Dec. 19, 1984, and that he suffered severe personal injuries resulting in physical and mental pain, anguish, fear and distress immediately prior to and at the time of his death." She is seeking $5 million in special and general damages and $15 million in punitive damages from the utility for herself and two children from a previous marriage. The disaster claimed the lives of 27 people. Last month, Ruth Hersh of Price filed a similar suit against UP&L, blaming the utility for the death of her husband, LeRoy. Both suits contend that I'P&L failed to provide a safe working environment by not ensuring the Wilberg had safe and operational fire detection, suppression and evacuation systems, as well as electrical, ventilation and communication systems and breathing apparatuses.
