Patio Washington Suit Must State Store By Robert S Halltday Tribune Environmental Specialist The question of whether a state can refus to store radioactive wastes has reached the couits in Washington State In March the Utah Legislature passed a law that l radioactive waste in prohibits storage of the state unless approved by the governor and Legislature Former President Carter, in a February lHO directive regarding site determination for a national nuclear waste repository, assured state officials they would have a continuing role in fedeial decision making on nuclear W'aste issues" and a part in the "concurrence" of site selection Veto Power The Utah legislation, sponsored by Sen Frances Lake City, gives Utah veto power over Farley, a repository location in the state rather than just the right to "concur" with a federal decision Washington voters passed an initiative last November providing that no non medical radioactive waste may be brought to Washington after July 1 unless the state enters into a regional "treaty" with other states to govern shipping and disposal Such an interstate compact has been drafted by the Washington governors office and is expected to sail through the Legislature It has already been approved by Idaho with Orpgon expected to follow. As drafted, only five other states are eligible to enter the agreement Utah, Montana, Wyoming, Alaska and Hawaii The Washington initiative was prompted by the increase use of the federal governments Hanford Atomic Reservation near Richland, Wash., as a dumping ground for radioactive waste and by reports that shipments to the site were poorly prepared and inadequately monitored. U.S. Flies Suit Last Monday the federal government sued the State of Washington to overturn the initiative, asking the U. S. District Court in Spokane to issue an injunction . Justice Department attorneys charged that the initiative violates the Constitution by regulating federal activities and interferes with national defense and Congress regulation of radioactive waste. The federal suit charges the state action would adversely affect the atomic energy programs of the Department of Energy and Defense Department programs. Both agencies store waste at Hanford Three weeks ago, another suit was filed against the initiative by several corporations, challenging the laws constitutionality. ; It could be an important test of states rights in refusing to accept nuclear trash. Citizens and officials of many states have taken, or are contemplating, legislative action to prevent nuclear dumping or even transportation. ! This is giving a headache to the Department of Energy, which is charged by Congress with siting one or more national nuclear waste repositories for long-ter(1,000 years) storage by 1997. Utah Possible Site DOE is examining prospective repository sites in several states, including Washington and Utahs bedded salt formations In the Paradox Basin, San Juan and Grand counties. It is this possible choice of Utah as a repository site that prompted Sen. Farleys legislation. - Colin A.
