Black-moralso Salem and a fugitive from justice; Jerry Brancucci, Denver, and Grant Roylance, Provo, are accused of threatening Newton Taylor and Alan Hovenden or a member of his family if a $750,000 loan was not repaid within seven days. The four are being tried before a jury empaneled by Chief Judge Aldon J Anderson, U.S. District Court for Utah The governments chief prosecutor, Samuel Alba, told the jury in opening statements that the defendants loaned the money to Mr. Taylor for investment purposes in January 1981. Mr. Taylor, acting as a finder, then put them in contact with Mr. Hovenden, and a gold refining business was set up in Texas Terms of the deal called for Mr. Crowther and his associates to be repaid at 5 percent a week interest. When the payments which had reached a high of $31,125 a week l, ceased in the defendants hired Mr. Brancucci, of the ABC Collection Co., who then threatened the two, the government contends. Mr. Crowthers story did not differ substantially, although in a lengthy opening statement, he said he did not loan any money to Mr. Taylor and Mr. Hovenden. He said the money came from a company, Merchants Exchange, in which he held a fiduciary position. He said he invested in a plan to earn interest from a booming gold and silver market and the agreement was under common law. He said Mr. Brancucci was not authorized to threaten the men with anything other than legal action.
