It concluded that Congress only intended to control sale of junk foods at mealtimes within food service areas, not throughout schools. The decision stemmed from a lawsuit filed by the soft drink industry and applied only to soft drinks. But the departments new proposal extended the provision to other foods. It would apply to some 90,000 schools nationwide. In a notice published in the Federal Register, the department said the rule would amend the regulations to restrict the sale of foods of minimal nutritional value only during the breakfast and lunch periods and areas. in But the federal standard only sets minimum nation rules. food-servi- being denied the right to vote on anything but the version President Reagan wants. Senate Majority Leader Howard H. Baker Jr., tried to get unanimous consent from all senators to schedule a vote Thursday afternoon on a constitutional amendment strongly favored by Reagan which would permit vocal organized prayer in the nations classrooms. Bakers request would have permitted no amendments other than one added by the Judiciary Committee, which would bar government officials from composing any school prayer. The Senate voted 96-Wednesday for that amendment, which was backed by Reagan. But Sen. Alan J. Dixon, protested against Baker's plan, saying he wanted to offer an amendment that would permit only silent prayer and meditation and guarantee equal access to public facilities by voluntary religious groups. Bakers request, Dixon said, narrows the issue to a single vote on the president's request in the terminology the president and his supporters want . . . with no opportunity for the Senate to discuss all the other important questions. This senator stands for silent prayer in the public schools. This senator does not support audible, vocal prayer or the concept by which some prayer can be written by anybody, he said. What Baker wants to do is narrow a major debate in this country affecting hundreds of millions of people to one question, Dixon said. Unable to secure agreement for a vote on the Reagan-backe- d proposal only, Baker announced he would be- - scheduling' votes On amendments. Baker said he h?d felt compelled to try to schedule a final vote after 10 days of Senate debate on the issue because you can negotiate forever, but finally a jury will make a judgment. Lowell Weicker, who is leading opposition Ho an amendment, said he was ready for a vote, provided It was only on the version supported by Reagan permitting vocal prayer. Weicker has said he believes he has the votes to defeat that version. But he has been unwilling to allow vera vote on a sion because a number of senators have said they could support that.
