In further consideration for the franchise herein granted, the Company during the life of this franchise shall agree to pay to the City four and (4.2) percent of the gross revenue per annum derived by said Com- from all subscribers fiany within the City of Murray and directly connected with the central office switching equipment of the Company located in said City. Basic local exchange revenue, as used herein, shall mean revenues received from the furnishing of telecommunications within a specified geographical area (exchange) and access to the telecommunications network to either business, residential or other customers whether on a flat rate or measured basis, by means of an access line. Basic local exchange service revenues shall not include revenues obtained by the telephone public utility company from the sale or lease of terminal telephone equipment services (such as basic telephone sets, private branch exchanges and key telephone or from other systems), telecommunications equipment which; is ottered for sale or lease from both the telephone company and other suppliers. Within forty-fiv- e days after the end of each month in a calendar year, the public utility taxed hereunder shall file with the City Treasurer of Murray City a report of its gross revenue derived from the sale and use of public utility service in Murray City as defined herein, together with a putation of the tax levied hereunder against the said utility. Coincidental with the filing of such report, the utility shall pay to the City Treasurer the amount of the tax due for that calendar month subject to said report. The Treasurer of said City shall determine the accuracy of the tax computation, and if he finds any errors, said Treasurer shall report the same to the Company for correction. If the tax as paid is found to be deficient, the Company shall promptly remit the difference, and if the tax as paid is found excessive, the City shall promptly refund the diference. The records of the Compnay pertaining to such report shall be open for inspection by the City or its duly authorized representatives at all reasonable hours upon the giving of reasonable notice of its intention to inspect such records for the purpose of verifying subject report. A store that has been in operation here for more than a decade is the focal point of recogni- - by the West Valley Area Chamber of Commerce in its tion accorded annual beautification program, which gets under way this week. Singled out for outstanding appearance is McDonalds at 3464 W. 3500 South, according to Clyde Marshall. A member of the Chambers board of directors who is in charge of the 1986 beautification program, Marshall said a slight variation will be followed this year. Conducted since the the program this year will honor five businesses and an equal number of residences during the course of the summer. Honorees will be selected from the s, communities of Bennion, Taylorsville, Kearns, Hunter and Granger, the area served by the Chamber. Cheerful and clean like all the McDonalds, this store was built in 1975, and a highlight of the area is a large pine tree that has been there ever since the store opened. The area is also decorated with a variety of shrubs, and tulips brighten the grounds in spring, while petunias are abundant at this time of year. Currently the ordinances prohibit issuance of a Class B License to an establishment located within 660 feet of a tavern or other business holding a Class C. Beer License.
