Hulbert and the charge was dismissed. Similarly, prosecutors also gave up trying to prove a conflict of interest indictment against Hulbert but Third District Judge Stewart M. Hanson, Jr., took the case under advisement. Its dismissal appeared imminent, observers said. The Salt Lake County Attor neys Office assumed prosecution chores on six remaining indictments when the seven-membgrand jury serving in Salt Lake County disbanded last December. Deputy County Attorney Richard S. Shepherd read two memorandums in Friday afternoons court session and indicated Hulbert could not be convicted on the latest two counts. The plaintiff does not feel it could produce sufficient evidence to prove its case against the commissioner in the liquor gift case, the first memorandum stated. Hulbert had been indicted last year for receiving three cases of liquor from the Buckingham distiller Corp., an supplying the liquor commission with alcoholic beverages for its state liquor retail monopoly. The whisky was addressed to Hulbert in October 1973 and a manifest document stated the cases were samples. The three cases were placed in the commissioners office closet and months later two of them were removed by investigators and resulted in the 1975 indictment, court documents indicated. The memorandum pointed out that the custom of submitting alcoholic beverages to the commission as samples or analytical liquor appears to have been common among many liquor distributors dealing with the state. This was evidenced by the large quantities found in the closets of Mr. Hulbert and other commissioners, it stated.
