Show preamble and act j I 1 in n relation to the construction of a canal from utah lake to lake whereas a large portion of the citizens of great salt lake county and vicinity vici have subscribed consid considerable erable amounts for the purpose durpos e of con strutting ting a canal connecting utah and great salt lakes for the purpose of navigation machinery and irrigating the land large bodies of which might be brought into successful cultivation if I 1 water to irrigate with could be procured and whereas the aforesaid subscribers do propose to obtain further farther subscriptions and petition for the territorial government to adopt some system I 1 of operations and appoint an agent or commissioners who shall be authorized to superintend ten d and construct said canal and award land claims I 1 to the subscribers equal to the amount which they shall pay respectively I 1 therefore to aid by our influence and desiring I 1 to encourage by our acts so ao desirable an all object SEC 1 be a it enacted by the governor and legislative assembly of the territory leantory lern tory of utah that ira eldredge jesse W fox aud and robert wimmer are auchoi authorized iced to locate the route for sid said canal solicit receive collect and disburse 1 subscriptions and generally do all other things necessary for the progress and completion of said work I 1 SEC 2 the aforesaid commissioners shall proceed without delay to locate said canal and make an estimate ol of the entire cost of its con st ruelon cion a upon n the plan hereinafter indicated SEC 3 go sud lu ld canal shall commence com menca above the rapids in jordan river where a dam shall be constructed ted across said river liver of sufficient height to cause slack water navigation to utah lake and proceed as near the base of the mountains on the I 1 west side of great salt lake valley as practicable I 1 to great salt lake and shall be of sufficient depth I 1 a and d width for tile the transportation of boats drawing two and a half feet of water and twelve feet j width of hull hall there shall also be good and sufficient guard locks aud and locks for le velling and waste gates as also large reservoirs reservoirs with good and s sufficient embankments to contain water for irrigating I 1 purposes at all convenient points SEC sac 4 the commissioners shall survey the lands which may be benent ted by tile the construction of said canal udon each side thereof likewise take into consideration the benefit arising to present holders of laud land claims and apportion the land claims according to the estimated expense and cost of said canal deservi reserving ng at each terminus and at such other convenient said canal to be located by the governor or his authorized zed agent to the amount of four sections of land to be held in reserve reserva for future use or disposal 1 I 1 SEC 5 the commissioners hhall then proceed and nd assign unto the subscribers respectively the possession of land claims and right of waiter water to irrigate equal to the precise amount which they have paid and no more accommodating locations already made as far as practicable and the residue shall be held in reserve for further subscription and it is distinctly understood that the right of water for navigation and machinery is held in reserve for future use or disposal SEC 6 the aforesaid commissioners shall make a full and complete report of their doings herein to the governor on or before the 1st ast day of october in each year and oftener if required a and id they shall hall also notify him when they have prepared pie prepared pared the apportionment that he make the rei serve of land claims and possessions above mentioned SEC 7 the expense incurred by surveying tile the land shall be taxed fixed upon the land claims an and be paid out of the subscriptions and the expense incurred by locating and surveying the proposed canal shall be defrayed by the subscriptions of the commissioners herein above appointed and in case c ase that the commissioners herein appo appointed anted do not of their or in case of a vacancy the governor is hereby authorized to appoint others in the management of certain property I 1 SEC 1 be it enacted by the governor and legislative assembly of the territory of utah that the probate judge in in each county is empowered and required to take possession of all property left by any deceased or abscond ent person when there is is no iio legal claimant known or sufficiently near to see to it in season and shall forthwith appraise and make two lists of said property and keep one on file and furnish one to the treasurer of the perpetual emigrating fund SEC 2 it is hereby made tile the duty or of every person having such property in his possession or terson knowing it to be in the possession of any other person to report the property forthwith and the n name a m e 0 of f the person in possession thereof to the P probate r bate judge of the county where said possessor is at the time and said judge shall take possession of such property as soon as practicable and proceed therewith as required above SEC 3 at the edri earliest iest practicable date the probate judge shall place said property or tile the avails thereof in the possession of said fund the value thereof to remain there until proven aw away ay by a legal claimant when said judge shall give an order on oil the treasurer of the fund SEC 4 A failure to comply with the requisitions of this act may be punished by costs damages and fine adjudged by any court having
